AN ORDINANCE ESTABLISHING THE RIGHT-OF-WAY
FOR THE HOPPER ROAD EXTENSION IN THE CITY OF
CAPE GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
SECTION 1. The Planning and Zoning Commission of the City of
Cape Girardeau, Missouri, did on April 12, 1989, accept and
approve the Preliminary Plans for the Hopper Road Extension and
the Preliminary Report for the Development of the Hopper Road
Extension as prepared and submitted by Bowen & Lawson, Engineers &
Surveyors.
SECTION 2. The Preliminary Plans and Preliminary Report for
the Hopper Road Extension as submitted to the Planning and Zoning
Commission and approved by the Planning and Zoning commission are
hereby adopted and approved by the City Council of Cape Girardeau.
SECTION 3. The City Council of Cape Girardeau, Missouri, does
hereby prohibit any new building from being located within the
proposed right-of-way of the Hopper Road Extension, as that
right-of-way is determined and delineated on the Preliminary Plans
approved by the Commission.
SECTION 4. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof.
SECTION 5. It is the intention of the governing body and it
is hereby ordained that the provisions of this ordinance shall
become and be made a part of the Code of Ordinances of the City of
Cape Girardeau, Missouri, and the sections of this Code may be
renumbered to accomplish such intention.
SECTION 6. This ordinance shall be in full force and effect
ten days after its passage and approval.
