AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF PART OF
TRACT NO. 5 OF KLAGES SUBDIVISION OF A PART
OF OUT LOT 77 IN U.S.P. SURVEY NO. 2199,
CITY AND COUNTY OF CAPE GIRARDEAU, MISSOURI
FROM R-1 TO C-2
WHEREAS, the City Planning and Zoning Commission has
recommended that all of the property described in Section 1 of
this ordinance should be rezoned from R-1 Single -Family Dwelling
District to C-2, General Commercial District; and
WHEREAS, Public Notice of such change was given as prescribed
in Chapter 30 of the Code of Ordinances of the City of Cape
Girardeau, Missouri, and public hearing was held on Monday, March
6, 1989; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in Section
1 from R-1, Single -Family Dwelling District to C-2, General
Commercial District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION 1. Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, is hereby amended to change the
zoning from the present R-1, Single -Family Dwelling District to
C-2, General Commercial District, for the following described
property:
The Southwest corner of Tract No. Five (5) of the Klages
Subdivision of a part of Out Lot 77 in the City of Cape
Girardeau, Missouri, described as follows: Begin at the
Southwest corner of Tract No. 5 of the Klages Subdivision
and run North 53° 54' East along the line between Lots 5
and 6 of the Klages Subdivision 360 feet; thence North 24
1/20 West 125 feet more or less to a corner in Thomas
Dirve; thence North 820 56' West along the South line of
Thomas Drive 200 feet to the West line of Tract No. 5 of
the Klages Subdivision; thence South 70 4' West along the
West line of Tract No. 5 of Klages Subdivision 350 feet
to the point of beginning.
All that part of Tract No. 5 of the Klages Subdivision of
a part of Out Lot 77 in U.S.P. Survey No. 2199, City of
Cape Girardeau, Cape Girardeau County, Missouri,
described as follows: Start at the southeast corner of
said Tract No. 5 of the Klages Subdivision; thence South
530 12' West along the South and East line of Tract No.
5, 250.0 feet for the point of beginning; thence North
360 48' West 200.0 feet; thence North 850 0' West 143.0
feet for a corner in the East line of Thomas Drive;
thence South 70 04' West along said East line, 245.0 feet
to the intersection of the East line of Thomas Drive with
the South line of said Drive; thence South 820 56' East,
174 feet to a corner in the South and East line of Tract
5; thence North 530 12' East along said line 139.4 feet
to the point of beginning.
SECTION 2. The City Council hereby finds and declares that
the property described in Section 1 hereof is at the present time
particularly suitable for the purposes and uses of C-2, General
Commercial District, and that such changes authorized hereby are
reasonable and in reasonable conformity with the existing uses and
value of the immediately surrounding properties.
SECTION 3. This ordinance shall be in full force and effect
ten days after its passage and approval.
