AN ORDINANCE ACCEPTING A SEWER EASEMENT FROM
D & D CAPE INVESTMENTS, L.P. AND THE CHARLES
DRURY TRUST TO SERVE THE PROPOSED FIRE
STATION NO. 2 SITE
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
SECTION 1. The City of Cape Girardeau, Missouri, hereby
accepts a Sewer Easement executed by D & D Cape Investments, L.P.,
a limited partnership in the State of Missouri, and the Charles
Drury Trust, conveying to the City of Cape Girardeau, Missouri, a
Sewer Easement to serve the proposed Fire Station No. 2 site, more
particularly described as follows, to -wit:
A permanent easement to construct, maintain and repair a
sanitary sewer line, manholes and other appurtenances, on
the following described real estate:
Commencing at the Northwest corner of Outlot No. 85; thence
South 820 26' 0" East, 35 feet to the East right-of-way
line of Mt. Auburn Road; thence along said East
right-of-way line South 60 0' 00" West, 143.3 feet to the
beginning of a curve, concave to the Northeast, having a
radius of 538.83 feet and a central angle of 24° 27' 0";
thence in a Southeasterly direction along said curve 229.94
feet to the point of tangency of said curve; thence South
180 27' 0" East, 1,825.82 feet to the South line of
Blattner Drive, being the point of beginning. Thence
continuing along the East right-of-way line of Mt. Auburn
Road South 180 27' 0" East, 480 feet; thence leaving said
East right-of-way line North 710 33' 0" East, 10 feet;
thence parallel to said East right-of-way line North 180
27' 0" West, 480 feet to a point on the South line of
Blattner Drive; thence along said South right-of-way line
South 710 29' 19" West, 10 feet and there terminating.
Also a temporary easement for construction purposes across
the above described tract.
SECTION 2. This ordinance shall be in full force and effect
ten days after its passage and approval.
