AN ORDINANCE AMENDING CHAPTERS 12, 15 AND 17
OF THE CODE OF ORDINANCES, ALL RELATING TO
HEALTH AND SANITATION
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
SECTION 1. Chapter 12 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, is hereby repealed in its entirety.
SECTION 2. Section 15-1 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, entitled "Health Officer; Office
Created; Appointment; Duties" is hereby repealed in its entirety
and a new Section 15-1 entitled "Health Officer; Office Created;
Appointment; Duties" is hereby enacted in lieu thereof in words
and figures as follows, to -wit:
Sec. 15-1. Health officer; office created; appointment;
duties.
There is hereby created the office of health officer.
The city manager shall appoint some suitable person to the
office of health officer with the consent of a majority
vote of the city council, who shall hold his office during
the pleasure of the city manager subject to majority
approval by the city council. The health officer shall
perform such duties as are prescribed by law or ordinance,
or directed by the council or city manager in matters
relating to health.
The city manager is hereby authorized to appoint the
Cape Girardeau County Public Health Center to act as health
officer for and on behalf of the City of Cape Girardeau.
This appointment is subject to the approval of the city
council of Cape Girardeau.
SECTION 3. Section 15-2 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, entitled "State Division of Health
Regulations adopted; penalty" is hereby repealed in its entirety
and a new Section 15-2 entitled "State Department of Health
Regulations adopted; penalty" is hereby enacted in lieu thereof in
words and figures as follows, to -wit:
Sec. 15-2. State Department of Health Regulations
adopted; penalty.
(a) The City of Cape Girardeau hereby adopts the
regulations of the Missouri Department of Health
contained in 19 Missouri Code of State Regulations
20-1.010 entitled "Sanitation of Food --Service
Establishments" and 19 Missouri Code of State
Regulations 20-1.020 entitled "Sanitation of Retail
Food Stores". These regulations shall govern retail
food stores and food service sanitation within the
City of Cape Girardeau and the health officer
designated pursuant to Section 15-1 of the Code of
Ordinance shall enforce these regulations pursuant to
said health officer's authority granted therein.
(b) Any person violating any of these regulations shall
upon conviction thereof be punished as prescribed in
Section 1-8 of this Code.
SECTION 4. Chapter 17 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, entitled "Milk and Milk Products" is
hereby repealed in its entirety.
SECTION 5. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof.
SECTION 6. It is the intention of the governing body and it
is hereby ordained that the provisions of this ordinance shall
become and be made a part of the Code of Ordinances of the City of
Cape Girardeau, Missouri, and the sections of this Code may be
renumbered to accomplish such intention.
SECTION 7. This ordinance shall be in full force and effect
ten days after its passage and approval.
