AN ORDINANCE ACCEPTING TEMPORARY CONSTRUCTION
EASEMENTS FROM GENE R. BRUNKHORST AND BETTY L.
BRUNKHORST; LEONARD W. LOWES AND HELEN J. LOWES;
AND ANN O'CONNELL FOR THE BELLERIDGE SEWER PROJECT
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a Temporary Construction Easement executed by Gene R.
Brunkhorst and Betty L. Brunkhorst, husband and wife, conveying to
the City of Cape Girardeau, Missouri, an easement for sewers in
the Belleridge Sewer Project, more particularly described as
follows, to -wit:
Part of Lot 6, Block 10, Belleridge Subdivision, a
subdivision of part of Fractional Sections 25 and 26 and
U.S.P.S. 2198, Township 3.1 North, Range 13 East, City and
County of Cape Girardeau, State of Missouri, being a strip
of land 15 feet in width lying along the North line of said
Lot 6, more particularly described as follows:
Commence at the Northeast corner of Fractional Section 26;
thence South 890 19' East along the North line of said
Belleridge Subdivision, 347.2 feet to the Northwest corner
of Lot 6, for the point of beginning; thence continue South
890 19' East along the North Lot line, 129.1 feet; thence
South 00 13' West, 15 feet; thence North 8911 19' West,
129.1 feet to a point on the West line of Lot 6; thence
North 00 13' East, 15 feet to the point of beginning
containing 1,936.5 square feet (0.0445 acres).
ARTICLE 2. The City of Cape Girardeau, Missouri, hereby
accepts a Temporary Construction Easement executed by Leonard W.
Lowes and Helen J. Lowes, husband and wife, conveying to the City
of Cape Girardeau, Missouri, an easement for sewers in the
Belleridge Sewer Project, more particularly described as follows,
to -wit:
Part of Lot 6, Block 9, Belleridge Subdivision, a
subdivision of part of Fractional Sections 25 and 26 and
U.S.P.S. 2198, Township 31 North, Range 13 East, City and
County of Cape Girardeau, State of Missouri, more
particularly described as follows:
Commence at the Northeast corner of Fractional Section 26;
thence South 890 19' East along the North line of
Belleridge Subdivision 163.1 feet to the Northeast corner
of Lot 6, Block 9, for the point of beginning; thence South
0° 13' West 15 feet along the East 1ine of said Lot 6;
thence North 891 19' West 25 feet;
15 feet; thence South 890 19' East
beginning containing 375 square fee
thence North 00 13' East
25 feet to the point of
t (0.0086 acres).
ARTICLE 3. The City of Cape Girardeau, Missouri, hereby
accepts a Temporary Construction Easement executed by Ann
O'Connell, Widow of Elmer O'Connell, Deceased, conveying to the
City of Cape Girardeau, Missouri, an easement for sewers in the
Belleridge Sewer Project, more particularly described as follows,
to -wit.
Part of Lot 12, Block 9, Belleridge Subdivision, a
subdivision of part of Fractional Sections 25 and 26 and
U.S.P.S. 2198, Township 31 North, Range 13 East, City and
County of Cape Girardeau, State of Missouri, being a strip
of land 15 feet in width lying along the North line of said
Lot 12, more particularly described as follows:
Commence at the Northeast corner of Fractional Section 26;
thence South 890 19' East along the North line of said
Belleridge Subdivision 163.1 feet to the Northwest corner
of Lot 12, Block 9, for the point of beginning; thence
continue South 890 19' East along the North _lot line 144.1
feet to the Northeast corner of said Lot 12; thence South
00 13' West along the East lot line of said Lot 12, 15
feet; thence North 890 19' West 144.1 feet to a point on
the West line of Lot 12; thence North 01 13' East to the
point of beginning, containing 2,161.5 square feet (0.0496
acres).
ARTICLE 4. This ordinance shall be in full force and effect
ten days after its passage and approval.
