AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO
BENTLEY AND WILMA RAMSEY AND TIM SINGLETON, FOR
PURPOSES OF CONSTRUCTING, MAINTAINING AND
OPERATING A 180 FOOT COMMUNICATIONS TOWER WITH
GUIDE WIRES, A COMMUNICATIONS/ANSWERING SERVICE
BUSINESS IN AN. EXISTING BUILDING, A RADIO
REPAIR/INSTALLATION SHOP AND A SIGN AT 2911
BLOOMFIELD ROAD, IN THE CITY AND COUNTY OF CAPE
GIRARDEAU, MISSOURI
WHEREAS, Bentley and Wanda Ramsey are the owners of certain
property in the City of Cape Girardeau, on which Tim Singleton
desires to construct, maintain and operate a 180 foot
communications tower with guide wires, a communications/answering
service business in an existing building, a radio
repair/installation shop and a sign; and
WHEREAS, the proposed location of said use is 2911 Bloomfield
Road, which ,property is presently zoned R-1, Single -Family
Dwelling District; and
WHEREAS, a Special Use Permit is required for said use in a
R-1 zone;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The City Council having duly considered the
application finds that the granting of the Special Use Permit will
not substantially increase traffic hazards, "congestion,, fire
hazards or adversely affect the general character of the
neighborhood or the general welfare of the community, nor will it
overtax public utilities or be in conflict with the comprehensive
plan.
ARTICLE 2. A Special Use Permit for purposes of constructing,
maintaining and operating a 180 foot communications tower with
guide wires, a communications/answering service business in an
existing building, a radio repair/installation shop and a sign, on
the following described property:
That part of Outlot 86 of U.S.P. Survey No. 2199, Township
30 North, Range 13 East of the Fifty Principal Meridian,
described as follows: Commence at the point of
intersection of the South side of Bloomfield Road and the
East line of Silver Spring Road; thence Easterly along the
South side of `said Bloomfield Road with the following:
North 670 00' East, 184.78 feet and North 810 30' east,
226.38 feet to an axle for a place of beginning; thence
continue along said road North 8211 39' 53" East, 241.59
feet to the North side of a concrete post ; thence South 40
58' 49" West, 272.00 feet to a concrete post; thence South
821 36' 35" West, 240.52 feet to a 1/2 inch iron rod;
thence North 40 45' East, 272.00 feet to the place of
beginning, in the City of Cape Girardeau, Cape Girardeau
County, Missouri, containing 1.4711 acres.
is hereby granted to Bentley and Wanda Ramsey and Tim Singleton,
to be effective ten (10) days after the date of passage and
approval of this ordinance. The special use must comply with all
regulations set forth in the Zoning Code for the district in which
the use is located except those which have been specifically
excepted under this permit, and all other applicable ordinances of
the City of Cape Girardeau and any special conditions contained in
the Special Use Permit, a copy of which is attached hereto and
incorporated herein by reference. The City Manager is hereby
given the power to execute the Special Use Permit for and on
behalf of the City of Cape Girardeau, Missouri.
ARTICLE 3. This ordinance shall be in full force and effect
ten days after its passage and approval.

SPECIAL USE PERMIT
Bentley and Wanda Ramsey, 2911 Bloomfield Road, Cape
Girardeau, MO 63701, and Tim Singleton, P. 0. Box 537, Cape
Girardeau, MO 63702-0537 are hereby granted a Special Use Permit
for purposes of constructing, maintaining and operating a 180 foot
communications tower with guide wires, a communications/answering
service business in an existing building, a radio
repair/installation shop and a sign, on the following described
property for an indefinite period of time:
That part of Outlot 86 of U.S.P. Survey No. 2199, Township
30 North, Range 13 East of the Fifty Principal Meridian,
described as follows: Commence at the point of
intersection of the South side of Bloomfield Road and the
East line of Silver Spring Road; thence Easterly along the
South side of said Bloomfield Road with the following:

This Special Use Permit is granted upon the condition that the
Applicant be bound by all City Ordinances which pertain to the
Special Use Permit and that the Applicant be bound by the
following conditions which are imposed as a condition of issuance
of this Special Use Permit. Upon the failure of the Applicant to
comply with these special conditions, the Special Use Permit will
automatically terminate with the right of the City of Cape
Girardeau to enter upon the land to abate such special use.
SPECIAL CONDITIONS:
1. Additions or modifications from the original building
permit must be approved by the City Council.
2. Special use shall meet all zoning regulations.
3. Installation of a new 180 foot communication tower.
4. A communications/answering service business office in the
existing residential building.
5. A radio repair/installation shop in the storage buildings
at the rear.
6. A maximum forty (40) square foot sign to be set back a
minimum of thirty (30) feet off the front property line.
