AN ORDINANCE ACCEPTING A QUIT CLAIM DEED FROM
DRURY DEVELOPMENT CORPORATION AND DRURY
INDUSTRIES, INC. FOR A PORTION OF SIEMERS DRIVE
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a Quit Claim Deed executed by Drury Development
Corporation, a Missouri corporation, and Drury Industries, Inc., a
Missouri corporation, conveying to the City of Cape Girardeau,
Missouri, a portion of Siemers Drive, more particularly described
as follows, to -wit:
LEGAL DESCRIPTION OF SIEMERS DRIVE RIGHT-OF-WAY
FROM
STATION 22+75 TO 50+85.51
(Including the Motel Entrance Road)
January 2, 1990
A part of United States Private Survey Number 3090,
Township 30 North, Range 13 East of the Fifth Principal
Meridian, County of Cape Girardeau, State of Missouri,
being more particularly described as follows:
Commencing at a point on the South line of United States
Private Survey Number 3090, from which the Southwest corner
of Lot Number 1 of Commissioner's Plat of Subdivision of
United States Private Survey 3090 bears North 851 01' 35"
West, 667.38 feet; thence North 490 21' 09" East, 1164.24
feet to a point on the Westerly right-of-way line of
Siemers Drive, said point being 30.00 feet left of
centerline Station 22+75, the following five (5) calls are
along the said Westerly right-of-way line:
Thence North 210 45' 00" West, 323.05 feet to a curve
concave to the Southwest having a radius of 633.15 feet
with an arc length of 257.88 feet to a point of tangency;
thence North 450 05' 12" West, 156.61 feet to a curve
concave to the Northeast, having a radius of 730.00 feet
with an arc length of 297.33 feet to a point of tangency;
thence North 21° 45' 00" West, 1305.10 feet to a. curve
concave to the East, having a radius of 709.01 feet with an
arc length of 309.28 feet to a point of tangency; thence
North 070 14' 52" East, 50.12 feet; thence North 030 14'
37" East, 108.75 feet to a point on the original
right-of-way of State Route K, said point being 35 feet
left of Siemers Drive centerline Station 50+70.39; thence
along said original right-of-way line, North 810 03' 18"
East, 71.61 feet to the Easterly right-of-way line of
Siemers Drive, said point being 35° right of Siemers drive
centerline Station 50+85.51; thence South 030 14' 37" West
along said Easterly right-of-way line 123.87 feet to the
beginning of a curve concave to the northeast having a
radius of 20 feet with an arc length of 30.71 feet; thence
South 86° 45' 23" East, 182.30 feet to a curve concave to
the north, having a radius of 290.56 feet with an arc
length of 126.75 feet to a point of tangency; thence North
681 15' 00" East, 141.06 feet to the beginning of a curve
concave to the Northwest, having a radius of 20.00 feet
with an arc length of 34.52 feet, thence South 300 37' 50"
East, 101.21 feet, to the beginning of a curve concave to
the Southwest, having a radius of 20.00 feet with an arc
length of 28.32 feet to a point of tangency; thence South
680 15' 00" West, 156.68 feet to the beginning of a curve
concave to the North, having a radius of 350.56 feet, with
an arc length of 152.92 feet to a point of tangency; thence
North 861 45' 23" West, 193.12 feet to the beginning of a
curve concave to the Southeast, having a radius of 20 feet,
with an arc length of 33.01 feet to the beginning of a
point on a compound curve, said curve being concave to the
East, having a radius of 649.01 .feet with an arc length of
231.47 feet, to a point of tangency; thence South 211 45'
00" East, 1305.10 feet, to the beginning of a curve concave
to the Northeast, having a radius of 670.00 feet with an
arc length of 272.89 feet to a point of tangency; thence
South 450 05' 12" East, 156.61 feet to the beginning of a
curve, concave to the Southwest, having a radius of 693.15
feet, with an arc length of 282.32 feet, to a point of
tangency; thence South 210 45' 00" East, 323.05 feet;
thence South 680 15' 00" West, 60 feet to the place of
beginning, containing in all 4.62 acres, more or less.
ARTICLE 2. This Ordinance shall be in full force and effect
ten days after its passage and approval.
