AN ORDINANCE ACCEPTING A QUIT CLAIM DEED FROM
HAROLD WERNER AND YVONNE WERNER AND AND A
GENERAL WARRANTY DEED FROM FRANCIS RHODES AND
EDVIRA RHODES FOR THE LEXINGTON AVENUE PHASE 2
PROJECT
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a Quit Claim Deed executed by Harold Werner and Yvonne
Werner, husband and wife, conveying to the City of Cape Girardeau,
Missouri, certain real estate for the Lexington Avenue Phase 2
Project, more particularly described as follows, to -wit:
Parcel No. 15-620-00-01-001.00(A)
All of that part of Survey No. 2198 and being located in
the Southwest Quarter of the Southeast Quarter of Section
24, Township 31 North, Range 13 East of the Fifth
Principal Meridian, Cape Girardeau County, Missouri,
described as follows:
From the Southwest corner of the Southwest Quarter of the
Southeast Quarter of Section 24, measure South 850 32'
East, along and with the South line of the Southwest
Quarter of the Southeast Quarter, a distance of 332.55
feet (recorded 334.0 feet) to the point of beginning;
thence North 040 08' East a distance of 97.97 feet;
thence South 780 16' East, a distance of 159.1 feet;
thence South 840 471 East a distance of 148.4 feet;
thence North 400 20' East a distance of 49.4 feet; thence
North 150 10' West a distance of 36.8 feet, more or less,
to the Westerly right-of-way line of Perryville Road;
thence South 200 20' East, along and with said
right-of-way line, a distance of 77.2 feet to the point
of a curve to the left; thence along and with the arc of
said curve to the left, with a radius of 1298.24 feet, a
distance of 96.4 feet, more or less, to the South line of
the Southwest Quarter of the Southeast Quarter; thence
North 840 46' West, along and with said South line a
distance of 398.3 feet, more or less, to the point of
beginning and containing 0.75 acres, subject to easements
and rights-of-way.
ARTICLE 2. The City of Cape Girardeau, Missouri, hereby
accepts a General Warranty Deed executed by Francis Rhodes and
Edvira Rhodes, husband and wife, conveying to the City of Cape
Girardeau, Missouri, certain real estate for the Lexington Avenue
Phase 2 Project, more particularly described as follows, to -wit:

All of that part of the West Half of the Northeast
Quarter of Fractional Section 26, Township 31 North,
Range 13 East of the Fifth Principal Meridian, Cape
Girardeau County, Missouri, described as follows:
From the Northwest corner of the Northeast Quarter of the
Northwest Quarter of said Section 26, measure South 890
45' East, along and with the North line of Section 26, a
distance of 1531.85 feet to an iron rod on the West
right-of-way line of State Route "W"; thence South 200
56' East, along and with said right-of-way line, a
distance of 90.85 feet to a right-of-way monument; thence
South 210 08' East, along and with said right-of-way
line, a distance of 990.46 feet to a right-of-way
monument at the Northwest corner of a 10.0 acre tract
previously conveyed; thence, Southeasterly, along and
with a right-of-way curve to the left (having a radius of
1945.08 feet), a distance of 253.27 feet to a 1/2 inch
iron rod for the point of beginning; thence,
southeasterly, along and with the right-of-way curve to
the left (having a radius of 1945.08 feet), a distance of
239.51 feet; thence, South 350 00' 26" East, along and
with the right-of-way line, a distance of 589.4 feet to
a point which lies 35.0 feet opposite and normal to
Highway "W" centerline station 502+63.7; thence South 100
08' 26" East, along and with the right-of-way line, a
distance of 71.47 feet to a point which lies in Cape
LaCroix Creek and being 60.0 feet opposite and normal to
Highway "W" centerline Station 503+38; thence, South 490
50' 27" West, along and with said creek, a distance of
316.99 feet to a point which lies on the North
right-of-way line of U.S. Route 1 and at 114.0 feet
opposite and normal to Highway 61 centerline Station
1003+17; thence North 550 22' 26" West, along and with
said right-of-way line, a distance of 67.0 feet; thence,
North 620 58' 07" West, along and with said right-of-way
line, a distance of 75.66 feet to a point which lies
104.0 feet opposite and normal to centerline Station
1001+75; thence North 550 22' 26"West, along and with
the right-of-way line, a distance of 191.50 feet; thence
North 820 07' 34" East, a distance of 66.91 feet; thence
North 390 37' 34" East a distance of 155.48 feet; thence
North 050 22' 26" West a distance of 113.1 feet; thence
North 300 52' 17" West a distance of 363.42 feet to the
Easterly line of property described in Book 440 at Page
588 in the Cape Girardeau County Recorder's Office;
thence North 190 03' 25" East, along and with said
Easterly line, a distance of 240.0 feet to the point of
beginning and containing 5.2 acres subject to easements
and rights-of-way.

ARTICLE 3. This ordinance shall be in full force and effect
ten days after its passage and approval.
