AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF A 24 ACRE
TRACT ON WEST BLOOMFIELD ROAD, CITY AND COUNTY
OF CAPE GIRARDEAU, MISSOURI FROM R-1 TO R-3
WHEREAS, the City Planning and Zoning Commission has
recommended that all of the property described in Article 1 of this
ordinance should be rezoned from R-1 Single -Family Dwelling
District to R-3, Two Family Dwelling District; and
WHEREAS, Public Notice of such change was given as prescribed
in Chapter 30 of the Code of ordinances of the City of Cape
Girardeau, Missouri, and public hearing was held on Monday,
December 2, 1991; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in Article
1 from R-1, Single -Family Dwelling District to R-3, Two Family
Dwelling District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, is hereby amended to change the zoning
from the present R-1, Single -Family Dwelling District to R-3, Two
Family Dwelling District, for the following described property:
A tract of land being part of U.S. Surveys No. 202, 679
and 787, in Township 30 North, Range 13 East, of the
Fifth Principal Meridian, County of Cape Girardeau, State
of Missouri, described as follows:
Start at an iron pin the Northeast corner of U.S.P.
Survey No. 679, Township 30 North, Range 13 East; thence
North 840 00' West, 1198.7 feet; thence North 60 00'
East, 384.81 feet; thence North 830 14' 07" West, 801.3
feet; thence South 410 55' West, 28.6 feet; thence with
the centerline of the abandon part of Bloomfield Road
South 310 07' West, 204.1 feet; thence South 370 13'
West, 158.2 feet; thence South 750 371 West, 134.32 feet
to a corner marked with a railroad spike for the point of
beginning; thence South 10 15' East 1082.52 feet; thence
South 680 16' 30" West, 587.44 feet, to an iron pin the
Northwest corner of Lot 8 of Briarwood Estates First
Subdivision; thence South 00 26' 02" East, 263.73 feet;
thence North 520 081 44" West, 808.50 feet to a point on
the Southeast right-of-way line of the Bloomfield Road;
thence with said Southeast right-of-way line as follows;
North 290 32' 27" East, 475.83 feet; thence with the arc
of a 90 06' 52" curve to the right a distance of 163.75
feet; thence North 440 24' 20" East, 164.98 feet; thence
with the arc of a 20 00' 51" curve to the right a
distance of 164.12 feet; thence North 470 42' 40" East,
112.56 feet; thence with the arc of a 140 43' 10" curve
to the right a distance of 171.67 feet; thence South 720
581 48" East, 126.92 feet; thence with the arc of a 90
391 46" curve to the left a distance of 154.44 feet;
thence North 720 58' 48" East, 103.65 feet to the point
of beginning, containing 24.11 acres more or less.
ARTICLE 2. The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present time
particularly suitable for the purposes and uses of R-3, Two -Family
Dwelling District, and that such changes authorized hereby are
reasonable and in reasonable conformity with the existing uses and
value of the immediately surrounding properties.
ARTICLE 3. This ordinance shall be in full force and effect
ten days after its passage and approval.
