AN ORDINANCE AMENDING THE BOUNDARIES OF
LATERAL SEWER DISTRICT NO. 14-1-D-1, A
SUBDIVISION OF TRUNK SEWER DISTRICT NO. 14-1-
D, APPROVING THE PLANS AND AUTHORIZING THE
CONSTRUCTION OF A SYSTEM OF SANITARY LATERAL
SEWERS IN LATERAL SEWER DISTRICT NO. 14-1-D-1,
UNDER A PRIVATE CONTRACT SUBJECT TO CERTAIN
PROVISIONS, IN THE CITY OF CAPE GIRARDEAU,
MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. Ordinance No. 645, passed and adopted November 16,
1988, is hereby amended, by amending the boundaries of Lateral
Sewer District No. 14-1-D-1, a subdivision of Trunk Sewer District
No. 14-1-D in the City of Cape Girardeau, Missouri, to read as
follows:
A Tract of land generally in the Southeast Quarter of
Section 23, Township 31 North, Range 13 East, of the
Fifth Principal Meridian, more particularly described as
follows:
Begin at the Southeast corner of said Section 23; thence
North 890 30' 08" West, 1390.03 feet along the South line
of said Section; thence North 00 53' 0" East, 495.85 feet
'to the Southeast corner of Woodland Place 6 Subdivision;
thence with the boundaries of said Woodland Place 6
Subdivision, North 820 271 11" West, 203.23 feet; thence
with a curve left having a radius of 275 feet and a
degree of curvature of 200 50' 0511, 31.98 feet; thence
with a curve right having a radius of 182.34 feet and a
degree of curvature of 310 25' 2111, 27.82 feet; thence
North 800 22' 33" West, 300.11 feet; thence North 400 01
0" East, 100 feet; thence North 680 38' 59" East, 141.98
feet; thence North 140 52' 18" East, 109.51 feet; thence
North 070 52' 48" East, 124.82 feet; thence South 870 02'
27" East, 258.49 feet, to the Northeast corner of said
Woodland Place 6th Subdivision; thence North 00 53' 0"
East, 1125.78 feet; thence South 890 07' 0" East, 50
feet; thence North 00 53' 0" East, 624.42 feet; thence
South 890 34' 08" East, 1340.04 feet, to the Northeast
corner of the Southeast Quarter of said Section 23;
thence South 00 53' 0" West, 2656.49 feet; along the East
line of said Section 23 to the point of beginning.
ARTICLE 2. That the plans for the construction of a system of
sanitary lateral sewers to serve Lateral Sewer District No. 14-1-D-
1, a copy of which is on file in the office of the City Clerk, are
hereby approved and ordered filed.
ARTICLE 3. That the owners of lands in said Lateral Sewer
District No. 14,-1-D-1 are hereby granted permission to construct
said system of sanitary lateral sewers in Sewer District No. 14-1-
D-1 and to connect same to existing sewers in Trunk Sewer District
No. 14-1-D, subject to the following provisions.
1. That proper authority has been secured to proceed from
the Missouri Clean Water Commission.
2. That all permanent easements for said sewers on private
property are made to the City of Cape Girardeau,
Missouri, prior to execution of a contract for the work
of construction of said sewers.
3. That all City Ordinances, Standard Specifications of the
City and State laws applicable to this project will be
observed in all respects.
4. That the quality of the work and materials be inspected
by the agents of the City engineer of the said City, and
that cost of said inspections be paid to said City
following the completion of the work and its acceptance
by said City and the Missouri Clean Water Commission.
ARTICLE 4. That this ordinance shall take effect and be in
full force from and after ten days following its passage and
approval.
