AN ORDINANCE ESTABLISHING THE BOUNDARIES OF
SEWER DISTRICT NO. 14-1-D-3, A SUBDIVISION OF
TRUNK SEWER DISTRICT NO. 14-1-D, APPROVING THE
PLANS AND AUTHORIZING THE 'CONSTRUCTION OF A
SYSTEM OF SANITARY LATERAL SEWERS IN SEWER
DISTRICT NO. 14-1-D-3, UNDER A PRIVATE
CONTRACT SUBJECT TO CERTAIN PROVISIONS, IN THE
CITY OF CAPE GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. That the boundaries of Sewer District No. 14-1-D-
3, a subdivision of Trunk Sewer District No. 14-1-D in the City of
Cape Girardeau, Missouri, shall be as follows:
A tract of land in the Southeast Quarter of Section 23,
Township 31 North, Range 13 East of the Fifth Principal
Meridian, City and County of Cape Girardeau, State of
Missouri, being more particularly described as follows:
Commence at the Southeast corner of said Section 23;
thence North 890 30' 08" West, 1390.03 feet along the
South line of said Section for a place of beginning;
thence North 00 531 01' East, 495.85 feet to the Southeast
corner of Woodland Place 6 Subdivision; thence with the
boundaries of said subdivision, North 820 27' 11" West,
203.23 feet; thence with a curve left having a radius of
275 feet and a degree of curvature of 200 50' 0511, 31.98
feet; thence with a curve right having a radius of 182.34
feet and a degree of curvature of 310 25' 2111, 27.82
feet; thence North 800 22' 33" West, 300.11 feet; thence
North 400 0' 0" East, 100 feet; thence leaving said
subdivision boundaries, South 680 38' 59" West, 39.84
feet; thence South 690 08' 57" West, 86.84 feet; thence
South 510 27' 11" West, 113.50 feet; thence South 230 21f
22" West, 231.78 feet; thence South 060 161 18" West,
119.70 feet; thence South 00 291 52" West, 254.53 feet;
thence South 890 30' 08" East, 734.79 feet, to the pont
of beginning.
ARTICLE 2. That the plans for the construction of a system of
sanitary lateral sewers to serve Sewer District No. 14-1-D-3, a
copy of which is on file in the office of the City Clerk, are
hereby approved and ordered filed.
ARTICLE 3. That the owners of lands in said Sewer District
No. 14-1-D-3 are hereby granted permission to construct said system
of sanitary lateral sewers in Sewer District No. 14-1-D-3 and to
connect same to existing sewers in Trunk Sewer District No. 14-1-D,
subject to the following provisions.
1. That proper authority has been secured to proceed from
the Missouri Clean Water Commission.
2. That all permanent easements for said sewers on private
property are made to the City of Cape Girardeau,
Missouri, prior to execution of a contract for the work
of construction of said sewers.
3. That all City Ordinances, Standard Specifications of the
City and State laws applicable to this project will be
observed in all respects.
4. That the quality of the work and materials be inspected
by the agents of the City engineer of the said City, and
that cost of said inspections be paid to said City
following the completion of the work and its acceptance
by said City and the Missouri Clean Water Commission.
ARTICLE 4. That this Ordinance shall take effect and be in
full force from and after ten days following its passage and
approval.
