AN ORDINANCE VACATING THE CITY'S INTEREST IN
AN ALLEY BETWEEN BLOOMFIELD AND GOOD HOPE, IN
THE CITY OF CAPE GIRARDEAU, MISSOURI

WHEREAS, the City Council has received a request from Kenneth
H. Lipps and Jennifer M. Lipps that the City vacate an alley
between Bloomfield and Good Hope, and more particularly described
in Section 1 hereof; and
WHEREAS, the date of October 21, 1991 has been set for a
public hearing on this request; and
WHEREAS, at least ten (10) days notice of the time and place
of this hearing was published in a newspaper of general circulation
in the City; and
WHEREAS, a public hearing was held on October 21, 1991 at
which all interested parties were afforded the opportunity to speak
in favor of or in opposition to the proposed alley vacation; and
WHEREAS, the City Council has determined that the alley in
question is not necessary or needed for the purposes for which it
was dedicated and established; and
WHEREAS, it is in the public interest that the alley be
vacated;
WHEREAS, an easement for overhead electric utilities is
necessary and should be reserved;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The City's interest in an alley on the following
described real estate:
An East/West alley running from the 300 block of South
Louisiana to a North/South alley running from Bloomfield
to Good Hope, in the City of Cape Girardeau, Missouri.
EXCEPT, HOWEVER, an easement for overhead electric
utility lines is hereby reserved.
is hereby vacated.
ARTICLE 2. Pursuant to Section 3.15 of the Charter of the
City of Cape Girardeau, Missouri, this measure is adopted as an
emergency measure as it constitutes a Bill concerning the immediate
preservation of public peace, property, health, safety or morals.
Accordingly, this ordinance will take effect immediately upon its
passage and approval,

behalf of said City by authority of its City Council and
acknowledged said instrument to be the free act and deed of said
City.
