AN ORDINANCE ACCEPTING A PERMANENT SEWER EASEMENT
FROM STOCKARD PROPERTIES, INC. AND HARRY W. RUST
AND BARBARA R. RUST, FOR LAND IN MID CITY BUSINESS
CENTRE
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a Permanent Sewer Easement executed by Stockard Properties,
Inc., a Missouri Corporation and Harry W. Rust and Barbara R. Rust,
his wife, conveying to the City of Cape Girardeau, Missouri, a
Permanent Sewer Easement for land in Mid City Business Centre
Subdivision, more particularly described as follows, to -wit:
A strip of land being 10.0 feet wide, 5.0 feet either
side of the following described centerline, to -wit:
Beginning at the northwest corner of Lot 2 of Westboro
Subdivision as recorded in Book 14, Page 82 of the Cape
Girardeau County Recorders plat book, said point being on
the South right-of-way line off Cape Centre Drive; thence
North 100 38' 47" East, 50.0 feet to the North right-of-
way line of said Cape Centre Drive; thence North 790 21'
13" West, 483.23 feet to the true point of beginning;
thence North 350 45' 13" West, 125.0 feet; thence North
130 11' 42" West, 400.0 feet; thence North 190 42' 49"
East, 120.0 feet to the termination of said easement.
ARTICLE 2. Pursuant to Section 3.15 of the Charter of the
City of Cape Girardeau, Missouri, this measure is adopted as an
emergency measure as it constitutes a Bill concerning the
immediate preservation of public peace, property, health, safety
or morals. Accordingly, this ordinance will take effect
immediately upon its passage and approval.
