AN ORDINANCE ESTABLISHING THE BOUNDARIES OF SEWER
DISTRICT NO. 14-2-D, A SUBDIVISION OF PARTS OF
TRUNK SEWER DISTRICT NO. 12 AND TRUNK SEWER
DISTRICT NO. 14-2 AND LATERAL SEWER DISTRICT NO.
12 -DD -1-A, APPROVING THE PLANS AND AUTHORIZING
T14E CONSTRUCTION OF A SYSTEM OF SANITARY LATERAL
SEWERS IN SEWER DISTRICT NO. 14-2-D, UNDER A
PRIVATE CONTRACT SUBJECT TO CERTAIN PROVISIONS,
IN THE CITY OF CAPE GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. That the boundaries of Sewer District No 14-2-D,
a subdivision .of parts of Trunk Sewer District No. 12 and Trunk
Sewer District No. 14-2 and. Lateral Sewer District No. 12 -DD -1-A
in the City of Cape Girardeau, Missouri, shall be as follows:
A part of Outlots 53, 54, and 61 of U.S. Private Survey No.
2199, Township 30 North,.Range 13 East, City and County of
Cape Girardeau, State of Missouri, being more particularly
described as follows:
Commencing at a stone marking the Southwest corner of
Outlot 53 and the Southeast corner. of Outlot 54 for a point
of beginning; thence North 810 44' 47" West along the south.
line of Outlot 54 1440.50 feet to a point on the centerline
of Wilson Road; thence South 671 19' 13" West along the
centerline of Wilson Road 1367.20 feet to the Southwest
corner of a tract of land conveyed to Charles Blattner and
Jerry E. Erlbacher as recorded in Book 356, at Page 670 in
the Cape Girardeau County Recorder's Office; thence North
60 15' 13" East along the West line of said property 778.88
feet to a point on the South right-of-way line of Rusmar
Street; thence South 890 06' East, 2.21 feet to a point on
a curve concave to the South, said curve having a radius of
575.00 feet; thence Easterly along said curve 50.68 feet
through a central angle of 50 03' to a point of tangency;
thence South 84° 03' East, 547.12 feet; thence North 50 57'
East 25 feet 'to the centerline of Rusmar Street; thence
South 840 03' East 225.0 feet; thence North 50 57' East
246:19 feet; thence North 841 03' West 686.75 feet; thence
North 50 57' East along a property line 564.79 feet; thence
North 661 34' 46" East 492.53 feet; thence South 840 03'
East 562.79 feet; thence to and along the centerline of
Cape LaCroix Creek as defined by the Cape LaCroix Creek
Cleaning Project in 1987 to the South line of Outlot #53
and Shawnee Park; thence Westerly along the South line of
Outlot #53 to the.point of beginning.
ARTICLE 2. That the plans for the construction of a system of
sanitary lateral sewers to serve Sewer District No. 14-2-D, a copy
of which is on file in the office of the City Clerk, are hereby
approved and ordered filed.
ARTICLE 3. That the owners of lands in said Sewer District
No. 14-2-D are hereby granted permission to construct said system
of sanitary lateral sewers in Sewer District No. 14-2-D and to
connect same to existing sewers in Trunk Sewer District No. 14-2,
subject to the following provisions.
1. That proper authority has been secured. to proceed from
the Missouri Clean water Commission.
2. That all permanent easements for said sewers on private
property are made to the City* of Cape Girardeau,
Missouri, prior to execution of a contract. for the work
of construction of said sewers.
3. That all City Ordinances, Standard Specifications of the
City and State laws applicable to this project will be
observed in all respects.
4. That the quality of the work and materials be inspected
by the agents of the City engineer of the said City, and
that cost of said inspections- be paid to said City
following the completion of the work and its acceptance
by said City and the Missouri Clean water Commission.
ARTICLE 4. That this Ordinance shall take effect and be in
full force from and after ten days following its passage and
approval.
