AN ORDINANCE ESTABLISHING THE BOUNDARIES OF SEWER
DISTRICT NO. 14-2-C, A SUBDIVISION OF TRUNK SEWER
DISTRICT NO. 14-2, APPROVING THE PLANS AND
AUTHORIZING THE CONSTRUCTION OF A SYSTEM OF
SANITARY LATERAL SEWERS IN SEWER DISTRICT NO.
14-2-C, UNDER A PRIVATE CONTRACT SUBJECT TO
CERTAIN PROVISIONS, IN THE CITY OF CAPE
GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. That.the boundaries of Lateral Sewer District No.
14-2-C,. a subdivision of Trunk Sewer District No,. 14-2 in the City
of Cape Girardeau, Missouri, shall be as follows:
A part of Lots 1 and 2 of Commissioners Plat of a
subdivision of U.S.P.S. 3090, Township 30 North, Range .13
East of the Fifth Principal Meridian, City and County of
Cape Girardeau, Missouri, more particularly described as
follows:
Beginning at a point on the East line of Lot No. 2 of said
Commissioners Plat of U.S.P.S. 3090 from which point the
Southeast corner of said Lot No. 2 bears South 40 46' 05"
West, 1785.35 feet; thence North 840 43' 15" West, 1045.49
feet; thence North 130 16' 59" West, 1665.71 feet to the
South right-of-way line of Missouri Route K; thence South
840 54' 31" East along said South right-of-way, 467.01
feet; thence North 60 55' 37" East, 15 feet; thence South
830 04' 23" East, 110.92. feet; thence in a Southeasterly
direction along a curve to the left having a radius of
2924.83 feet, a distance of 188.03 feet; thence South 860
45' 23" East, 120.79 feet; thence leaving said
right-of-way, South 50 54' 00" West, 471.81 feet; thence
South 830 03' 00" East, 390.20 feet; thence South 50 54'
00" West, 456.70 feet; thence South 500 30' 00" East,
808.97 feet; thence South 211 45' 00" East, 171.52 feet;
thence North 84° 43' 15" West, 425.61 feet to the point of
beginning.
ARTICLE 2. That the plans for the construction of a system of
sanitary lateral sewers to serve Lateral Sewer District No.
14-2-C, a copy of which is on file in the office of the City
Clerk, -are hereby approved and ordered filed.
ARTICLE 3. That the owners of lands in said Lateral Sewer
District No. 14-2-C are hereby, granted permission to construct
said system of sanitary lateral sewers in Lateral Sewer District
No. 14-2-C and to connect same to existing sewers in Trunk Sewer
District No. 14-2, subject to the following provisions.
1. That proper authority has been secured to proceed from
the Missouri Clean Water Commission.
2. That all permanent easements for said sewers on private
property. are 'made to the City of Cape Girardeau,
Missouri, prior to execution of a contract for the work
of construction of said sewers.
3. That all City Ordinances, Standard Specifications of the
City and State laws applicable to this project will be
observed in all respects.
4. That the quality of the work and materials be inspected
by the agents of the City engineer of the said City, and
.that cost of said inspections be paid to said City
following the completion of the work and its acceptance
by said City and the Missouri Clean Water Commission.
ARTICLE 4. That this Ordinance shall take effect and be in
full force from and after ten days following its' passage and
approval.
