ORDINANCE NO. 10,37
AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE A
QUIT CLAIM DEED TO JOSEPH GOLENIOWSKI AND FRANCES
GOLENIOWSKI, FOR LAND ON GORDONVILLE ROAD
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The Mayor, for and on behalf of the City of Cape
Girardeau, Missouri, is hereby authorized, to execute a Quit Claim
Deed conveying real estate to Joseph Goleniowski and Frances
Goleniowski, his wife, for land on Gordonville Road, described as
follows, to -wit:
A tract of land adjacent to Park West Heights Subdivision
in U.S.P.S. 2199, Township 30 North, Range 13 East, City of
Cape Girardeau, Missouri, more particularly described as
follows:
Commence at the Southeast corner of lot 1, Park West
Heights Subdivision, being a .point on the North
right-of-way line of Gordonville Road; thence South 75
degrees, 22 minutes, 0 seconds West, along said
right-of-way line 4.17 feet to a curve to the left; thence
along said curve to the left having a radius of 621.95 feet
and a length of 201.64 feet to the East side of a 50 foot
roadway easement; thence Southeasterly along a curve having
a radius of 30.00 feet, and a length of 44.69 feet to a
curved line, South and parallel to the old North
right-of-way line of Gordonville Road; thence Northeasterly
along said parallel curved line having a radius of 591.95
feet and a length of 165.06 feet to a point; thence North
75 degrees, 22 minutes, 0 'seconds East, 4.89 feet to a
point, said point being a projection of the East line of
said lot l; thence North 16 degrees, 01 minutes, 0 seconds
West, 30.01 feet to the point of beginning. Containing
5,856 square feet more or less..
The Grantor expressly reserves an easement across the above
described tract for utility purposes.
ARTICLE 2. Pursuant to Section 3.15 of the
City of Cape Girardeau, Missouri, this measure is
emergency measure as it constitutes a Bill
immediate preservation of public peace, property,
or morals. Accordingly, this ordinance will
immediately upon its passage and approval.

ARTICLE 3. The purchase price of the above described property
shall be five hundred dollars and no cents (500.00) payable at
the time. of delivery of the deed authorized herein.

A.D. One Thousand Nine Hundred Ninety -One, by and betwOen the CITY
OF CAPE GIRARDEAU, MISSOURI', a Municipal Corporation, of the
County of Cape Girardeau and State of Missouri, party of the First
Part, and JOSEPH GOLENIOWSKI and FRANCES GOLENIOWSKI, his wife,
2902 Gordonville Road, Cape Girardeau, MO 63701, of the County of
Cape Girardeau, in the State of Missouri; parties of the Second
Part,
WITNESSETH, That the said party of the First Part in
consideration of the sum of Ten Dollars ($10.00) and other good
and valuable consideration, to it paid by the said parties of the
Second Part, the receipt of which is hereby acknowledged, does by
these presents, Remise, Release and forever Quit Claim, unto said
parties of the Second Part, the following described Lots, Tracts
or Parcels of land, lying, being and situate in the County of Cape
Girardeau and State of Missouri, to -wit:

TO HAVE AND TO HOLD THE SAME, with all the rights, immunities,
privileges and appurtenances thereto belonging, unto the said
parties of the Second Part, and their heirs, successors and
assigns, FOREVER, so that neither the said party of the First
Part, nor its successors or assigns, or any other person or
persons for it or in its name or behalf, shall or will hereafter
claim or demand any right or title to the aforesaid premises or
any part thereof, but they and every one of them shall, by these
presents, be e,xcluded and forever barred.
IN WITNESS WHEREOF, the said party of, the First Part has
hereunto set its hand the day and year first above written.

Francis E. Rhodes, to me personallly known, who, being by me duly
sworn, did say that he is the Mayor of the City of Cape Girardeau,
Missouri, a Municipal Corporation of the State of Missouri, and
that the seal affixed to the foregoing instrument is the seal of
said City and that the -said instrument was signed and sealed in
behalf of said City by authority of its City Council and
acknowledged said instrument to be the free act and deed of said
City.
