AN ORDINANCE AMENDING CHAPTER 22 OF THE CITY CODE
RELATING TO SOLID WASTE
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. Section 22-34 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, entitled "Bulky Rubbish
Collected; How" is hereby repealed in its entirety and a new
Section 22-34 entitled "Bulky Rubbish Collected; How" is hereby
enacted in lieu thereof, in words and figures, as follows, to -wit:
Sec. 22-34. Bulky Rubbish Collected; How.
All solid waste from premises to which collection
services are provided by the city shall be collected,
except as elsewhere provided in this chapter, and except
for bulky rubbish, provided, however, that bulky rubbish
may be collected according to regulations and charges to be
made and promulgated by the city staff as hereinafter
provided. Bulky rubbish shall not be collected upon
regular collection days, but shall be collected upon
request to the city staff and according to procedures
established by the city staff. Nothing in this chapter
shall require the city to collect any bulky rubbish that
the city staff determines to be harmful to its collection
equipment, or that cannot be adequately disposed of by the
disposal methods utilized by the city.
ARTICLE 2. Section 22-35 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, entitled "Waste Containers;
Where Placed" is hereby amended by repealing Subparagraph (a) in
its entirety and enacting in lieu thereof a new Subparagraph (a),
in words and figures, as follows, to -wit:
Sec. 22-35. Waste Containers; Where Placed.
(a) All residential waste containers shall be placed
within three (3) feet of the curb or edge of roadway, or
alley where ordered by the city staff, for collection,
except as elsewhere provided for in this chapter. Such
containers shall be placed at the curb, or edge of roadway,
or alley, on or twelve (12) hours prior to the day of
collection, and removed on the same day within a reasonable
time. Such containers shall be made to prevent blowing or
spreading of refuse in any way and be stored on private
property, in such a manner that such containers shall not
become an eyesore or public nuisance.
ARTICLE 3. Section 22-39 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, entitled "Disposal of Waste;
Fee" is hereby amended by repealing Subparagraph (b) in its
entirety and enacting a new Subparagraph (b) in lieu thereof, in
words and figures, as follows, to -wit:
Sec. 22-39. Disposal of Waste; Fee.
(b) Haulers who dispose of less than twenty (20) tons
of solid waste per week at the city disposal facility shall
pay a rate of twenty-one dollars (21.00) per ton. Private
haulers who regularly use the disposal facility and who
regularly dispose of more than twenty (20) tons of solid
waste per week at the city disposal facility shall have a
rate established by contract based on the operating fee and
the tipping fee. All fees to be established are subject to
imposed costs due to existing or newly mandated state and
federal regulations.
ARTICLE 4. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof.
ARTICLE 5. It is the intention of the governing body and it
is hereby ordained that the provisions of this ordinance shall
become and be made a part of the Code of Ordinances of the City of
Cape Girardeau, Missouri, and the sections of this Code may be
renumbered to accomplish such intention.
ARTICLE 6. This ordinance shall be in full force and effect
ten days after its passage and approval.
