AN ORDINANCE ACCEPTING PERMANENT EASEMENTS FROM
ROBERT L. FORD AND CAROL D. FORD AND YONG AE KIM
AND YONG KIE KIM FOR LEXINGTON AVENUE PHASE 1-C
STREET PROJECT AND FOR THE CAPE LACROIX
INTERCEPTOR PHASE IV (SAN DANGARO TRUNK SEWER
LINE) PROJECT
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a Permanent Easement executed by Robert L. Ford and Carol
D. Ford, husband and wife, conveying to the City of Cape
Girardeau, Missouri, a Permanent Easement for the Lexington Avenue
Phase 1-C Street Project and for the Cape LaCroix Interceptor
Phase IV (San Dangaro Trunk Sewer Line) Project, more particularly
described as follows, to -wit:
All of that part of the West Half of the Northeast Quarter
of Fractional Section 26, Township 31 North, Range 13 East
of the Fifth Principal Meridian, Cape Girardeau County,
Missouri, described as follows:
From the Northwest corner of the Northeast Quarter of the
Northwest Quarter of said Section 26, measure Easterly,
along and with the Section line, a distance of 1531.85 feet
to an iron rod on the West right-of-way line of State Route
"W"; thence South 200 56' East, along and with said
right-of-way line, a distance of 90.85 feet to a
right-of-way monument; thence South 211 08' East, along and
with said right-of-way line, a distance of 990.46 feet to a
right-of-way monument at the Northwest corner of a 10.0
acre tract heretofore conveyed; thence continue along said
right-of-way on a curve to the left having a radius of
1945.08 feet, a distance of 253.27 feet to a 1/2 inch iron
rod; thence South 191 03' 25" West a distance of 60.0 feet
to the center of Cape LaCroix Creek for the point of
beginning; thence continue South 190 03' 25" West a
distance of 180.0 feet; thence North 301 52' 17" West a
distance of 138.83 feet to the North line of property
described in Book 440 at Page 588 in the Cape Girardeau
County Deed Records; thence North 190 03' 25" East, along
and with said property line, a distance of 145.0 feet to
the center line of Cape LaCroix Creek; thence
Southeasterly, along and with said center line, a distance
of 120.03 feet, more or less, to the point of beginning and
containing 0.40 acres.
ARTICLE 2. The City of Cape Girardeau, Missouri, hereby
accepts a Permanent Easement executed by Yong Ae Kim and Yong Kie
Kim, her husband, conveying to the City of Cape Girardeau,
Missouri, a Permanent Easement for the Lexington Avenue Phase 1-C
Street Project and for the Cape LaCroix Interceptor Phase IV (San
Dangaro Trunk Sewer Line) Project, more particularly described as
follows, to -wit:
All of that part of Lot 2 of Rhodes Subdivision of a part
of the West one-half of the Northeast Quarter of Section
26, Township 31 North, Range 13 East of the Fifth Principal
Meridian, Cape Girardeau County, Missouri, described as
follows:
From the Northwest corner of the Northeast Quarter of the
Northwest Quarter of Section 26, measure Easterly, along
and with the Section line, a distance of 1531.85 feet to an
iron rod on the West right-of-way line of State Route "W";
thence South 200 56' East, along and with the right-of-way
line, a distance of 90.85 feet to a right-of-way monument;
thence South 210 08' East, along and with said right-of-way
line, a distance of 990.46 feet to a right-of-way monument
at the Northwest corner of a 10.0 acre tract heretofore
conveyed; thence North 210 08' West, along and with said
right-of-way line, a distance of 968.80 feet to a 1/2 inch
iron rod; thence South 20 37 1/2' West to a point on the
center line of Cape LaCroix Creek; thence in a
Southeasterly direction, along and with said center line,
to the Northwest corner of property described in Book 44.0
at Page 588 in the Cape Girardeau County Deed Records for
the point of beginning; thence Southeasterly, along and
with the center line of Cape LaCroix Creek, a distance of
120.0 feet, more or less, to the Northeast corner of
property described in Book 440 at Page 588; thence North
19° 03' 25" East, a distance of 60.0 feet to the Westerly
right-of-way line of State Route "W"; thence Northwesterly,
along and with said right-of-way line, a distance of 165.0
feet; thence South 740 07' 43" West, a distance of 80.0
feet; thence North 151 52' 17" West, a distance of 60.0
feet; thence South 591 07' 43" West, a distance of 67.0
feet, more or less, to the center line of Cape LaCroix
Creek; thence Southeasterly, along and with said center
line, to the point of beginning and containing 0.43 acres.
ALSO:
All of that part of the West One -Half of the Northeast
Quarter of Section 26, Township 31 North, Range 13 East of
the Fifth Principal Meridian, Cape Girardeau County,
Missouri, described as follows:
From the Northwest corner of the Northeast Quarter of the
Northwest Quarter of said Section 26, measure Easterly,
along and with the Section line, a distance of 1531.85 feet

to the center line of Cape LaCroix Creek; thence
Northwesterly, along and with said center line, a distance
of 120.03 feet to the Northwesterly corner of property
described in Book 440 at Page 588 in the Cape Girardeau
County Deed Records for the point of beginning; thence
South 19° 03' 25" West, a distance of 145.0 feet; thence
North 30° 52' 17" West, a distance of 245.0 feet; thence
North 59° 07' 43" East, a distance of 63.0 feet, more or
less, to the center line of Cape LaCroix Creek; thence
Southeasterly, along and with said center line, to the
point of beginning and containing 0.42 acres.
ARTICLE 3. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof.
ARTICLE 4. This ordinance shall be in full force and effect
ten days after its passage and approval.
