HomeMy WebLinkAboutOrd.1011.05-20-1991BILL NO. 91-74 ORDINANCE NO. '01/ AN ORDINANCE ACCEPTING A TEMPORARY ACCESS EASEMENT AND A' TEMPORARY CONSTRUCTION EASEMENT FROM VERNON E. RHODES AND CAROL S. RHODES FOR THE CAPE LACROIX INTERCEPTOR PHASE IV (SAN DANGARO TRUNK SEWER LINE) PROJECT ARTICLE 1. The City of Cape Girardeau, Missouri, hereby accepts a Temporary Access Easement executed by Vernon E. Rhodes and Carol S. Rhodes, husband and wife, conveying to the City of Cape Girardeau, Missouri, a Temporary Access Easement for the Cape LaCroix Interceptor Phase IV (San Dangaro Trunk Sewer Line) Project, more particularly described as follows, to -wit: All of that part of the West Half of the Northeast Quarter of Fractional Section 26, Township 31 North, Range 13 East of the Fifth Principal Meridian, Cape Girardeau County, Missouri, described as follows: From the Northwest corner of the Northeast Quarter of the Northwest Quarter of said Section 26, measure South 890 45' East, along and with the North line of Section 26, a distance of 1531.85 feet to an iron rod on the West right-of-way line of State Route "W"; thence South 200 56' East, along and with said right-of-way 'line, a distance of 90.85 feet to a right-of-way monument; thence South 210 08' East, along and with said right-of-way line, a distance of 990.46 feet to a right-of-way monument at the Northwest corner of a 10.0 acre tract previously conveyed; thence Southeasterly along and with a right-of-way curve to the left (having a radius of 1945.08 feet), a distance of 253.27 feet to a 1/2 inch iron rod located on the Easterly line of property described in Book 440 at Page 588 in the Cape Girardeau County Recorder's Office; thence South 190 03' 25" West, along and with said Easterly line, a distance of 240.0 feet for the point of beginning; thence South 300 52 17" East, a distance of 363.42 feet; thence South 050 22' 26" East, a distance of 113.1 feet; thence South 390 37' 34" West, a distance of 155.48 feet; thence South 820 07' 34" West, a distance of 66.91 feet to a point which lies on the North right-of-way line of U. S. Route 61 and at 104.0 feet opposite and normal to the centerline Station 999+83.50; thence North 550 21' 26" West, along and with the right-of-way line, a distance of 63.50 feet; thence North 820 31' West along said right-of-way, 89.44 feet to a point 50.0 feet opposite and mean to centerline Station 998+40; thence North 550 57' West, along said right-of-way, 64.0 feet to an iron rod located on the above described Easterly line of property; thence North 191 03' 25" West, along and with said Easterly line, a distance of 497.76 feet, more or less, to the point of beginning and containing 2.6 acres, subject to easements and rights-of-way. ARTICLE 2. The City of Cape Girardeau, Missouri, hereby accepts a Temporary Construction Easement executed by Vernon E. Rhodes and Carol S. Rhodes, husband and wife, conveying to the City of Cape Girardeau, Missouri, a Temporary Construction Easement for the Cape LaCroix Interceptor Phase IV (San Dangaro Trunk Sewer Line) Project, more particularly described as follows, to -wit. All of that part of the West one-half of the Northeast Quarter of Fractional Section 26, Township 31 North, Range 13 East of the Fifth Principal Meridian, Cape Girardeau County, Missouri, more particularly described as follows: A tract of land 30 feet wide lying West and Southerly of the following described line, being the West line of a tract conveved to the City of Cape Girardeau: Commence at an iron pin at the intersection of the West right-of-way of Missouri Route "W" and the Easterly line of property described in Book 440 at Page 588 in the Cape Girardeau County Recorder's Office; thence South 190 03' 25" West, 240 feet along said Easterly line for a point of beginning; thence South 30° 52' 17" East, 363.42 feet and there terminating. ARTICLE 3. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions hereof.
