AN ORDINANCE ACCEPTING GENERAL WARRANTY DEEDS
FROM JOE K. 'GOODMAN, BARBARA GOODMAN, MARK
GREGORY GOODMAN AND CHRISTINE PETRE GOODMAN; AND
WILLIAM L. McKINNEY AND CAROLE ANN MCKINNEY AND
ACCEPTING A WARRANTY DEED AND A PERMANENT ACCESS
EASEMENT FROM CAPE CENTRE DEVELOPMENT CORP. FOR
THE CAPE LACROIX CREEK/WALKER BRANCH FLOOD
CONTROL PROJECT
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a General Warranty Deed executed by Joe K. Goodman and
Barbara Goodman, husband and wife, and* mark Gretory Goodman and
Christine Petre Goodman, husband and wife, conveying to the City
of Cape Girardeau, Missouri, a General Warranty Deed for the Cape
LaCroix Creek/Walker Branch Flood Control Project, more
particularly described as follows, to -wit:
No. 20-307-00-01-005.00
That part of Lot No. 2 of Sturdivant's Subdivision of
Outlots 58, 59, 81 and a part of 60 in U.S.P. Survey No.
2199, Township 30 North, Range 13 East, in the City and
County of Cape Girardeau, State of Missouri, described as
follows:
Commence at the Southwest Corner of said Outlot No. 81;
thence Northerly with the line between Outlots 81 and 82, a
distance of 719.7 feet, to a point on the North right of
way line of Independence Street (Old State Route "K");
thence South 830 36' 34" East, with said North line, 410.6
feet; thence North 60 23' 26" East, 105.42 feet, to the
place of beginning; thence North 660 24' 31" West, 4.21
feet; thence North 591 33' 55" West, 105.1 feet; thence
North 060 23' 26" East, 62.24 feet; thence South 791 11'
34" East, 100.3 feet; thence South 6° 23' 26" West, 98.58
feet, to the place of beginning and containing 8,068 sq.
feet.
ARTICLE 2. The City of Cape Girardeau, Missouri, hereby
accepts a General Warranty Deed executed by William L. McKinney
and Carole Ann McKinney, conveying to the City of Cape Girardeau,
Missouri, a General Warranty Deed for the Cape LaCroix
Creek/Walker Branch Flood Control Project, more particularly
described as follows, to -wit:
No. 20-312-00-07-005.00
That part of Lot No. 1 of a Subdivision of the Rodney 400
Arpen Tract in U.S.P. Survey No. 2199, Township 30 North,
Range 13 East, City and County of Cape Girardeau, State of
Missouri, described as follows:
Commence at the Northwest Corner of Walnut Street and
Commercial Street as shown on the plat of Part of Lot 1 of
the Rodney 400 Arpen Tract, and recorded in Plat Book 5 at
Page 51, in the office of the Recorder of said Cape
Girardeau County, Missouri; thence South 791 03' 29" East,
50.0 feet, to the Northeast Corner of said Walnut Street,
and Commercial Street; thence North 10° 56' 31" East, with
the East line of Commercial Street; 811.6 feet; thence
South 790 03' 29" East, 177.71 feet, to the place of
beginning; thence continue South 79" 03' 29" East, 93.99
feet; thence South 141 23' 53" East, 65.13 feet; thence
North 82" 08' 29" West, 98.24 feet; thence North -100 26'
35" West, 41.50 feet; thence North 7° 46' 13" West, 26.92
feet, to the place of beginning and containing 6,001.0 sq.
feet.
ARTICLE 3. The City of Cape Girardeau, Missouri, hereby
accepts a Warranty Deed executed by Cape Centre Development Corp.
a Missouri Corporation, conveying to the City of Cape Girardeau,
Missouri, a Warranty Deed for the Cape LaCroix Creek/Walker Branch
Flood Control Project, more particularly described as follows,
to -wit:
That part of Lot 1 of Westborough Subdivision, in the City
and County of Cape Girardeau, State of Missouri, as
recorded in Plat Book 14 at Page 82 and described as
follows:
Commence at the Northeast Corner of said Lot No. 1, the
place of beginning, being in the center of Cape LaCroix
Creek, and on the South line of Missouri State Route "K";
thence with said South line, North 85° 54' 07" West, 70.0
feet; thence South 731 16' 43" West, 41.94 feet; thence
South 20 47' 39" West, 99.01 feet; thence South 110 34' 35"
West, 122.19 feet; thence South 00 16' 57" East, 330.91
feet; thence South 230 35' 58" East, 116.35 feet; thence

ARTICLE 4. The City of Cape Girardeau, Missouri, hereby
accepts a Permanent Access Easement executed by Cape Centre
Development Corp. a Missouri Corporation, conveying to the City of
Cape Girardeau, Missouri, a Permanent Access Easement for the Cape
LaCroix Creek/Walker Branch Flood Control Project, more
particularly described as follows, to -wit:
That part of Lot No. .l of Westborough Subdivision, in the
City and County of Cape Girardeau, State of Missouri, as
recorded in Plat Book 14 at Page 82 and' described as
follows:
Commence at the intersection of the West line of U.S. Route
61 and the North line of Cape Centre Drive; thence North
780 53' 30" West, with the North line of said Cape Centre
Drive, 628.34 feet, to the place, of beginning; thence
continue North 780 53' 30" West, 30.0 feet; thence North
100 09' 32" East, 281.58 feet; thence North 660 24' 02"
East, 16.03 feet; thence South 230 35' 58" East, 30.0 feet;
thence South 10° 09' 32" West, 266.05 feet, to the place of
beginning and containing 8,455 sq. feet.
ARTICLE 5. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof.
ARTICLE 6. This ordinance shall be in full force and effect
ten days after its passage and approval.
