AN ORDINANCE ESTABLISHING THE BOUNDARIES OF
LATERAL SEWER DISTRICT NO. 14-2-B, A SUBDIVISION
OF TRUNK SEWER DISTRICT NO. 14-2, APPROVING THE
PLANS AND AUTHORIZING THE CONSTRUCTION OF A
SYSTEM OF SANITARY LATERAL SEWERS IN LATERAL
SEWER DISTRICT NO. 14-2-B, UNDER A PRIVATE
CONTRACT SUBJECT TO CERTAIN PROVISIONS, IN THE
CITY OF CAPE GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. That the boundaries of Lateral Sewer District No.
14-2-B, a subdivision of Trunk Sewer District No. 14-2 in the City
of Cape Girardeau, Missouri, shall be as follows:
Part of USPS 175, Township 30 North, Range 13 East, and
USPS 3090, Township 31 North, Range 13 East, of the Fifth
Principal Meridian, Cape Girardeau County, Missouri, and
more particularly described as follows:
Begin at a point on the South line of USPS 3090, from which
the Southwest corner of Lot No. 1, Commissioners Plat
Subdivision of USPS No. 3090 bears North 850 01' 35" West,
667.38 feet; thence North 390 50' 18" East, 659.6 feet;
thence North 210 45' 00" West, 1561.90 feet; thence North
500 30' 00" West, 809.0 feet; thence North 050 54' 00"
East, 456.7 feet; thence North 830 02' 00" West, 384.3
feet; thence North 050 55' 00" East, 522.0 feet to the
South line of Missouri State Route K; thence with said
South line in an Easterly direction to the point of
intersection with the West line of Interstate Route 55;
thence Southerly with said West line to the point of
intersection with the North line of bloomfield Road; thence
with said North line, ,South 330 31' 00" East, 15 feet;
thence South 550 53' 23" West, 472.37 feet; thence leaving
said North line North 270 10' 54" West, 2073.33 feet to the
point of beginning.
ARTICLE 2. That the plans for the construction of a system of
sanitary lateral sewers to serve Lateral Sewer District No.
14-2-B, a copy of which is on file in the office of the City
Clerk, are hereby approved and ordered filed.
ARTICLE 3. That the owners of lands in said Lateral Sewer
District No. 14-2-B are hereby granted permission to construct
said system of sanitary lateral sewers in Lateral Sewer District
No. 14-2-B and to connect same to existing sewers in Trunk Sewer
District No. 14-2, subject to the following provisions.
1. That proper authority has been secured to proceed from
the Missouri Clean Water Commission.
2. That all permanent easements for said sewers on private
property are made to the City of Cape Girardeau,
Missouri, prior to execution of a contract for the work
of construction of said sewers.
3. That all City Ordinances, Standard Specifications of the
City and State laws applicable to this project will be
observed in all respects.
4. That the quality of the work and materials be inspected
by the agents of the City engineer of the said City, and
that cost of said inspections be paid to said City
following the completion of the work and its acceptance
by said City and the Missouri Clean Water Commission.
ARTICLE 4. That this Ordinance shall take effect and be in
full force from and after ten days following its passage and
approval.
