AN ORDINANCE ACCEPTING A QUIT CLAIM DEED FROM
CAPE GIRARDEAU COUNTY, MISSOURI, FOR THE
LEXINGTON AVENUE EXTENSION PROJECT
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a Quit Claim Deed executed by Cape Girardeau County,
Missouri, a political subdivision of the State of Missouri,
conveying to the City of Cape Girardeau, Missouri, a Quit Claim
Deed for the Lexington Avenue Extension Project, more particularly
described as follows, to -wit:
All of that part of the Northeast Quarter of the
Northeast Quarter of fractional section 30, the North
half of the Northwest Quarter and the Northwest Quarter
of the Northeast Quarter of fractional section 29, the
South half of the Southwest Quarter of the Southeast
Quarter and the South half of the Southwest Quarter of
section 20, the South half of the Southeast Quarter of
the Southeast Quarter of Section 19, and U.S. public
survey no. 3091, Township 31 North, Range 14 East of the
fifth principal meridian, Cape Girardeau County,
Missouri, described as follows:
From the corner common to sections 19, 20, 29, and
30, measure S 4 degrees 51 minutes W a distance of 14.0
feet to the point of beginning, being an iron pin of the
South right-of-way line of Melody Lane; thence, S 84
degrees 24 minutes E a distance of 1,218.4 feet to an
iron pin; thence, S 84 degrees 48 minutes E a distance of
1,431.4 feet to an iron pin; thence, N 84 degrees 49
minutes E a distance of 310.6 feet to the point of a
curve to the right; thence, along the arc of said curve
to the right, with a radius of 435.0 feet, a distance of
245.8 feet; thence S 52 degrees 28 minutes E a distance
of 37.4 feet, more or less, to the westerly right-of-way
of Route 177 (Big Bend Road); thence, an angle right of
84 degrees 18 minutes 03" to the tangent of a curve to
the right; thence, along the arc of said curve to the
right, with a radius of 868.51 feet, a distance of 50.1
feet; thence, N 52 degrees 28 minutes W a distance of
33.9 feet to the point of a curve to the left; thence,
along the arc of said curve to the Left, with a radius of
485.0 feet, a distance of 274.0 feet; thence N 84 degrees
49 minutes W a distance of 310.9 feet, thence N 84
degrees 48 minutes W a distance of 1,430.9 feet; thence,
N 84 degrees 24 minutes W a distance of 1,248.9 feet to
an iron pin at the Southeast corner of Delaware Park;
thence, N 85 degrees 57 minutes W a distance of 1,308.7
feet to an iron pin at the Southwest corner of Delaware
Park and on the Easterly right-of-way of old Sprigg
Street; thence S 04 degrees 42 minutes W, with the said
right-of-way line, a distance of 50.0 feet; thence S 85
degrees 50 minutes E a distance of 301.0 feet to an iron
pin; thence, S 86 degrees 08 minutes E a distance of
119.5 feet to an iron pin; thence, S 85 degrees 58
minutes E a distance of 888.2 feet, more or less, to the
point of beginning and containing 5.28 acres (229,991.5
square feet), subject to easements and rights-of-way.
ARTICLE 2. This ordinance shall be in full force and effect
ten days after its passage and approval.
