AN ORDINANCE REPEALING SECTION 22-48(b) OF THE
CITY CODE RELATING TO SOLID WASTE AND
REPEALING SECTION 29-67(b) OF THE CITY CODE
RELATING TO SEWERS, AND ENACTING NEW SECTIONS
IN LIEU THEREOF
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. Section 22-48(b) of the Code of Ordinances of the
City of Cape Girardeau, Missouri, relating to solid waste, reading
as follows:
Sec. 22-48. Billing; payment; delinquency; penalty.
(b) All bills issued under this article shall be due
and payable twenty-one (21) days from the date the bill
was rendered; those accounts not paid in accordance
therewith shall be deemed delinquent. All accounts which
become delinquent shall be charged a ten (10) percent
penalty.

the Code of Ordinances of the City of Cape Girardeau, Missouri,
relating to solid waste, is hereby enacted in lieu thereof, in
words and figures, to read as follows:

(b) All service bills shall be due and payable in
full fourteen (14) days from the date the bill was
rendered and shall be considered delinquent after twenty-
one (21) days. If the last day for remittance falls upon
a weekend or holiday, or any other day when the offices
of the department, regularly used for the payment of
customer bills, are not open to the general public, the
final payment date shall be extended through to the close
of the next business day. The date of payment for
remittance through the mail shall be the date on which
the department receives the remittance. All accounts
which become delinquent shall be charged a ten (10)
percent penalty.

payable within ten (10) days of mailing thereof; those
accounts not paid in accordance therewith shall be deemed
delinquent. All accounts which have been delinquent for
twenty-one (21) days or longer shall be charged a ten
(10) percent penalty. The date of penalty and the amount
thereof shall be shown on the face of the bill.

ARTICLE 3. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof.
ARTICLE 4. It is the intention of the governing body and it
is hereby ordained that the provisions of this ordinance shall
become and be made a part of the Code of Ordinances of the City of
Cape Girardeau, Missouri, and the sections of this Code may be
renumbered to accomplish such intention.
ARTICLE 5. This ordinance shall be in full force and effect
ten days after its passage and approval.
