AN ORDINANCE ACCEPTING A PERMANENT EASEMENT
AND A TEMPORARY CONSTRUCTION EASEMENT FROM
ROBERT A. DRURY AND ANNA R. DRURY FOR A CITY
OF CAPE GIRARDEAU WATER MAIN
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a Permanent Easement executed by Robert A. Drury and Anna
R. Drury, husband and wife, conveying to the City of Cape
Girardeau, Missouri, a Permanent Easement for the City of Cape
Girardeau Municipal Water Main, more particularly described as
.follows, to -wit:
All of that part of the Southeast Quarter of Section 26,
Township 30 North, Range 13 East of the Fifth Principal
Meridian, in the County of Scott, State of Missouri, more
particularly described as follows:
Commence at a 1/2" diameter iron rod set in concrete
marking the Southwest corner of Section 26; thence East
with the South line of said Section 26, 2,788.07 feet, to
a point at the intersection of Little River Drainage
District Ditch No. 1 and the East line extended of Little
River Drainage District Ditch No. 4A, from which the
Southeast corner of said Section 26 bears East, 2,631.87
feet; thence with Little River Drainage District Ditch
No. 4A, North 000 35' 02" West, 2,608.71 feet, to a point
on the South line of Nash Road; thence with said South
line, South 890 38' 50" East, 22.99 feet; thence North
880 531 58" East, 572.40 feet; thence North 880 25' 18"
East, 76.71 feet; thence South 000 511 29" West, 403.26
feet, to the beginning of a non -tangent curve, being
concave to the Southeast, said curve having a radius of
833.94 feet; thence along the arc of said curve a
distance of 115.38 feet, ( the chord across said arc bears
South 150 41' 5411 West, 115.29 feet), to a point on the
North line of a tract recorded in deed book 468, pages
459-460, the place of beginning; thence continue along
the arc of said curve a distance of 250.48 feet, (the
chord across said arc bears South 030 07' 48" West,
249.54 feet) , to a point on the South line of a tract
described in deed book 468, pages 459-460; thence with
said South line South 890 46' 49" East, 10.05 feet, to a
point on the West right-of-way line of the Cape Girardeau
Airport Access Road; thence with said West right-of-way
line, along a non -tangent curve having a radius of 823.94
feet, a distance of 250.53 feet, (the chord across said
arc bears North 030 10' 00" East, 249.56 feet); thence
North 890 52' 0211 West, 10.21 feet, to the place of
beginning and containing 2,505 square feet, more or less.
Also,
That part of the Southeast Quarter of Section 26,
Township 30 North, Range 13 East, of the Fifth Principal
Meridian, in the County of Scott, State of Missouri, more
particularly described as follows:

marking the Southwest corner of said Section 26; thence
East, with the South line of said Section 26, 2,788.07
feet, to a point at the intersection of Little River
Drainage District Ditch No. 1 and the East line extended
of Little River Drainage District Ditch No. 4A, from
which the Southeast corner of said Section bears East,
2,631.87 feet; thence with Little River Drainage District
Ditch No. 4A, North 000 351 0211 West, 2,608.71 feet, to
a point on the South line of Nash Road; thence with said
South line, South 890 38, 5011 East, 22.99 feet; thence
North 880 53' 5811 East, 572.40 feet; thence North 880 25'
1811 East, 76.71 feet; thence South 000 51, 2911 West,
403.26 feet, to the beginning of a non -tangent curve,
being concave to the southeast, said curve having a
radius of 833.94 feet; thence along the arc of said curve
a distance of 680.56 feet (the chord across said arc
bears South 030 431 0111 East, 661.83 feet) , to the place
of beginning; thence continue along the arc of said curve
to the left, having a radius of 833.94 feet, a distance
of 55.47 feet (the chord across said arc bears South 290
00' 0511 East, 55.46 feet) ; thence South 320 31' 1011 East,
1.88 feet; thence South 890 48' 0811 East, 11.66 feet, to
a point on the West line of the Cape Girardeau Airport
Access Road; thence with said West line North 310 10' 2511
West, 7.91 feet; thence along the arc of a curve to the
right, having a radius of 823.94 feet, a distance of
49.64 feet (the chord across said arc bears North 290 101
5211 West, 49.63 feet) ; thence North 890 48' 0811 West,
11.27 feet, to the place of beginning, and containing 547
square feet, more or less.
ARTICLE 2. The City of Cape Girardeau, Missouri, hereby
accepts a Temporary Construction Easement executed by Robert A.
Drury and Anna R. Drury, husband and wife, conveying to the City of
Cape Girardeau, Missouri, a Temporary Construction Easement for the
City of Cape Girardeau Municipal Water Main, more particularly
described as follows, to -wit:
All of that part of the Southeast Quarter of Section 26,
Township 30 North, Range 13 East of the Fifth Principal

particularly described as follows:

on the South line of Nash Rad; thence with said South
line, South 890 38' 5011 East, 22.99 feet; thence North
880 53' 58" East, 572.40 feet; thence North 880 25' 1811
East, 76.71 feet; thence South 000 51' 2911 West, 403.26
feet, to the beginning of a non -tangent curve, being
concave to the Southeast, said curve having a radius of
833.94 feet; thence along the arc of said curve a
distance of 115.38 feet, (the chord across said arc bears
South 150 41' 5411 West, 115.29 feet), to a point on the
North line of a tract recorded in deed book 468, pages
459-460, the place of beginning; thence continue along
the arc of said curve, a distance of 250.48 feet, (the
chord across said arc bears South 030 07' 4811 West,
249.54 feet), to a point on the South line of a tract
described in deed book 468, pages 459-460; thence with
said South line, North 890 46' 4911 West, 20.10 feet;
thence along a non -tangent curve having a radius of
853.94 feet, a distance of 250.39 feet, (the chord across
said arc bears North 030 03' 3311 East, 249.49 feet);
thence South 890 52' 0211 East, 20.41 feet, to the place
of beginning and containing 5,009 square feet, more or
less.

thence along the arc of a non -tangent curve, being
concave to the Northeast, and having a radius of 853.94
feet, a distance of 56.91 feet, (the chord across said
arc bears North 280 18' 5311 West, 56.90 feet) , thence
South 890 48' 08t1 East, 22.44 feet, to the place of
beginning and containing 1,142 square feet, more or less.
ARTICLE 3. This ordinance shall be in full force and effect
ten days after its passage and approval.
