AN ORDINANCE ACCEPTING A PERMANENT EASEMENT
AND A TEMPORARY CONSTRUCTION EASEMENT FROM
JERRY LIPPS AND RUTH W. LIPPS FOR A CITY OF
CAPE GIRARDEAU WATER MAIN
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a Permanent Easement executed by Jerry Lipps and Ruth W.
Lipps, husband and wife, conveying to the City of Cape Girardeau,
Missouri, a Permanent Easement for the City of Cape Girardeau
Municipal Water Main, more particularly described as follows, to -
wit:
All of that part of the Northeast Quarter of Section 26,
Township 30 North, Range 13 East of the Fifth Principal
Meridian, in the County of Cape Girardeau, State of
Missouri, described as follows:
Commence at a 1/211 diameter iron rod set in concrete
marking the Southwest corner of said Section 26, thence
with the South line of said section, East, 2,738.07 feet,
to a point at the intersection of Little River Drainage
District Ditch No. 1 and Little River Drainage District
Ditch No. 4A, from which the Southeast corner to said
section --bears East_,-- 2-,681 37 --feet, thence wit Little
River Drainage District Ditch No. 4A, North 000 35' 0211
West, 2,699.02 feet, to a point on the surveyed
centerline of existing Nash Road, thence North 000 03'
5411 West, 65.00 feet, to a point on the North line to
said Nash Road, thence South 890 38' 5011 East, 85.00
feet, to the intersection of the North line of Nash Road,
with the East line of said Ditch No. 4A, thence North 00
03' 5411 West, 9.93 feet, to the place of beginning;
thence North 890 31' 2111 East, 541.15 feet, thence South
000 35' 0611 West, 4.91 feet, thence South 890 24' 5411
East, 10.00 feet, thence North 000 35' 0611 East, 5.00
feet, thence South 890 24' 5411 East, 86.76 feet, thence

square feet, more or less.
ARTICLE 2. The City of Cape Girardeau, Missouri, hereby
accepts a Temporary Construction Easement executed by Jerry Lipps
and Ruth W. Lipps, husband and wife, conveying to the City of Cape
Girardeau, Missouri, a Temporary Construction Easement for the City
of Cape Girardeau Municipal Water Main, more particularly described
as follows, to -wit:
All of that part of the Northeast Quarter of Section 26,

Missouri, described as follows:

with the East line of said Ditch No. 4A, the place of

thence South 890 24' 5411 East, 648.13 feet, thence South
000 311 0611 West, 40.00 feet, to a point on the North
line of Nash Road, thence with said North line, North 890
24' 5411 West, 632.78 feet, thence North 890 38' 5011 West,
14.94 feet, to the place of beginning and containing
- 25,-918 square _feet, moreorless,- -excepting 6,879 -square
feet, more or less, being within the permanent easement.
ARTICLE 3. This ordinance shall be in full force and effect
ten days after its passage and approval.
