AN ORDINANCE ACCEPTING A GENERAL WARRANTY DEED
AND A QUIT CLAIM DEED FROM JUDITH ANN SHRUM
SNEATHEN FOR THE CAPE LA CROIX CREEK/WALKER
BRANCH FLOOD CONTROL PROJECT, DETENTION
RESERVOIR ACCESS ROAD; AND ACCEPTING A
PERMANENT EASEMENT AND A TEMPORARY
CONSTRUCTION EASEMENT FROM JUDITH ANN SHRUM
SNEATHEN; AND A PERMANENT EASEMENT AND A
TEMPORARY CONSTRUCTION EASEMENT FROM WILLIAM
D. VIED AND SHARON L. VIED FOR CONSTRUCTION OF
A SANITARY SEWER EXTENSION IN CONJUNCTION WITH
THE CAPE LA CROIX CREEK/WALKER BRANCH FLOOD
CONTROL PROJECT, DETENTION RESERVOIR ACCESS
ROAD
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a General Warranty Deed executed by Judith Ann Shrum
Sneathen, conveying to the City of Cape Girardeau, Missouri, a
General Warranty Deed for the Cape La Croix Creek/Walker Branch
Flood Control Project, Detention Reservoir Access Road, more
particularly described as follows, to -wit:
That part of Lot No. 6 in La Croix Industrial Park, a
Subdivision of a part of the Northeast Quarter of the
Northwest Quarter, and a part of the Northwest Quarter of
the Northeast Quarter of Section 23, Township 31 North,
Range 13 East, County of Cape Girardeau, State of
Missouri, described as follows:
Begin at the Southwest corner of said Lot No. 6; thence
North 880 05' 23" East, with the south line of said Lot
No. 6, 40.0 feet; thence North 460 17' 07" West, 55.95
feet, to a point on the west line of said Lot No. 6;
thence South 000 39' 37" East, 40.0 feet, to the place of
beginning and containing 800 square feet, more or less.
ARTICLE 2. The City of Cape Girardeau, Missouri, hereby
accepts a Quit Claim Deed executed by Judith Ann Shrum Sneathen,
conveying to the City of Cape Girardeau, Missouri, a Quit Claim
Deed for the Cape La Croix Creek/Walker Branch Flood Control
Project, Detention Reservoir Access Road, more particularly
described as follows, to -wit:
All that part of LaSalle Street and Laporte Street in La
Croix Industrial Park Amended subdivision recorded in
Plat Book 15 at Page 38, described as follows:
Commence at the north quarter corner of Section 13,
Township 31 North, Range 13 East as shown on said
subdivision plat of La Croix Industrial Park Amended;
thence North 890 301 West, 295.5 feet, to the east line
of LaSalle Street, said point being the northwest corner
of Lot 9; thence South 10 27' West along the east line of
LaSalle Street, 937.38 feet, more or less, to the
southwest corner of Lot 6; thence South 890 48' East,
242.8 feet, to a point on the South line of Lot 6; thence
northeast along the south line of Lot 6 to a point on the
west line of Lot 11, said point being South 10 27' West,
163.73 feet from the northwest corner of Lot 11 and being
on the east line of Weston Street as shown on said plat;
thence southeast along the west line of Lot 11 and the
east line of Weston Street 67.8 feet to the southwest
corner of Lot 11 also being on the north right of way of
Route W; thence southwest 50 feet along the north right
of way line of Route W to the intersection of the south
line of LaPorte Street and the north right of way line of
Route W; thence North 890 481 West, 424.45 feet, along
the south line of LaPorte Street, said point being South
10 271 West, 50 feet, from the southeast corner of Lot 1;
thence North 10 27' East, 987.64 feet, along the west
line of LaSalle Street to the northeast corner of Lot 5;
thence South 890 30' East, 50 feet, to the point of
beginning.
ARTICLE 3. The City of Cape Girardeau, Missouri, hereby
accepts a Permanent Easement executed by Judith Ann Shrum Sneathen,
conveying to the City of Cape Girardeau, Missouri, a Permanent
Easement for construction of a sanitary sewer extension in
conjunction with the Cape La Croix Creek/Walker Branch Flood
Control Project, Detention Reservoir Access Road, more particularly
described as follows, to -wit:
All that part of Lot 6 in the La Croix Industrial Park
Subdivision recorded in Plat Book 15 at Page 18 in the
Office of the Recorder of Deeds, in the County of Cape
Girardeau, State of Missouri, more particularly described
as follows:
Commence at the Southeast corner of said Lot 6, thence
North 000 37' 47" West along the East line of said lot,
a distance of 23.66 feet to the place of beginning,
thence continue North 000 371 47" West, along the East
line of said lot a distance of 16.52 feet, thence South
640 36' 01" West, a distance of 152.30 feet, more or
less, to a point in the South line of said lot, thence
North 880 07' 13" East, along the South line of said lot,
a distance of 37.59 feet, thence North 860 36' 01" East,
a distance of 110.91 feet to the place of beginning, and
containing 1,974 square feet, more or less.
ARTICLE 4. The City of Cape Girardeau, Missouri, hereby
accepts a Temporary Construction Easement executed by Judith Ann
Shrum Sneathen, conveying to the City of Cape Girardeau, Missouri,
a Temporary Construction Easement for construction of a sanitary
sewer extension in conjunction with the Cape La Croix Creek/Walker
Branch Flood Control Project, Detention Reservoir Access Road, more
particularly described as follows, to -wit:
All that part of Lot 6 in the La Croix Industrial Park
Subdivision recorded in Plat Book 15 at Page 18 in the
office of the Recorder of Deeds, in the County of Cape
Girardeau, State of Missouri, more particularly described
as follows:
Beginning at the Southeast corner of said Lot 6, thence
South 750 56' 42" West, a distance of 97.70 feet, thence
South 880 07' 13" West, 68.33 feet, thence North 640 361
01' East, a distance of 85.16 feet, thence South 460 231
37" East, a distance of 4.76 feet, thence North 430 36'
2311 East, a distance of 12.40 feet, thence North 640 361
01" East, a distance of 81.45 feet, more or less, to a
point in the East line of said lot, thence South 000 371
47" East along the East line of said lot, a distance of
11.01 feet, thence South 640 36' 01" West, a distance of
152.30 feet, more or less, to a point in the South line
of said lot, thence North 880 07' 13" East, along and
with the South line of said lot a distance of 37.59 feet,
thence North 640 36' 01" East, a distance of 110.91 feet,
more or less, to a point in the East line of said lot,
thence South 000 37' 47" East, along the East line of
said lot, a distance of 23.66 feet, to the place of
beginning and containing 2,764 square feet, more or less.
ARTICLE 5. The City of Cape Girardeau, Missouri, hereby
accepts a Permanent Easement executed by William D. Vied and Sharon
L. Vied, husband and wife, conveying to the City of Cape Girardeau,
Missouri, a Permanent Easement for construction of a sanitary sewer
extension in conjunction with the Cape La Croix Creek/Walker Branch
Flood Control Project, Detention Reservoir Access Road, more
particularly described as follows, to -wit:
All that part of Lot 11 in the La Croix Industrial Park
Subdivision, recorded in Plat Book 15 at Page 18 in the
Office of the Recorder of Deeds, in Cape Girardeau
County, State of Missouri, more particularly described as
follows:
Commence at the Southeast corner of said Lot 11, said
corner having M.S.P.C. Northerly: 553,524.14 and
Easterly: 1,089,561.07, thence North 000 37' 47" West,
along the East line of said lot, 32.62 feet to the place
of beginning, thence continue North 000 37' 47" West,

along the East line of said lot, 15.01 feet, thence South
870 42' 44" West, 174.94 feet, thence South 000 371 47"
East, 15.01 feet, thence North 870 42' 44" East, 174.94
feet, to the place of beginning and containing 2,624
square feet, more or less.
ARTICLE 6. The City of Cape Girardeau, Missouri, hereby
accepts a Temporary Construction Easement executed by William D.
Vied and Sharon L. Vied, husband and wife, conveying to the City of
Cape Girardeau, Missouri, a Temporary Construction Easement for
construction of a sanitary sewer extension in conjunction with the
Cape La Croix Creek/Walker Branch Flood Control Project, Detention
Reservoir Access Road, more particularly described as follows, to -
wit:
All that part of Lot 11 in the La Croix Industrial Park
Subdivision, recorded in Plat Book 15 at Page 18 in the
office of the Recorder of Deeds, in Cape Girardeau
County, State of Missouri, more particularly described as
follows:
Commence at the Southeast corner of said Lot 11, said
corner having M.S.P.C. Northerly: 553,524.14 and
Easterly: 1,089,561.07, thence North 000 37' 47" West,
along the East line of said lot, a distance of 27.62
feet, to the place of beginning, thence continue North
000 37' 47" West, along the East line of said lot, a
distance of 30.02 feet, thence South 870 421 4410 West, a
distance of 174.94 feet, thence South 000 371 47" East,
a distance of 10.01 feet, thence North 870 42' 44" East,
a distance of 174.94 feet, thence South 000 37' 47" East,
a distance of 15.01 feet, thence South 870 42' 44" West,
a distance of 174.94 feet, thence South 000 44" 47" East,
a distance of 5.00 feet, thence North 870 42' 44" East,
a distance of 174.94 feet to the place of beginning and
containing 2,624 square feet, more or less.
ARTICLE 7. This ordinance shall be in full force and effect
ten days after its passage and approval.
