AN ORDINANCE VACATING THE CITY'S INTEREST IN A
PORTION OF BRUCHER STREET RIGHT-OF-WAY, IN
THE CITY OF CAPE GIRARDEAU, MISSOURI
WHEREAS, the City Council has received a request that the City
vacate a portion of Brucher Street right-of-way, and more
particularly described in Section 1 hereof; and
WHEREAS, the City Council set the date of April 4, 1994, for
a public hearing on this request; and
WHEREAS, at least ten (10) days notice of the time and place
of this hearing was published in a newspaper of general circulation
in the City; and
WHEREAS,, a public hearing was held on April 4, 1994, at which
all interested parties were afforded the opportunity to speak in
favor of or in opposition to the proposed right-of-way vacation;
and
WHEREAS, the City Council has determined that the Brucher
Street right-of-way in question is not necessary or needed for the
purposes for which it was dedicated and established; and
WHEREAS, it is in the public 'interest that the said right -of -
way be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The City's interest in a portion of Brucher Street
right-of-way, on the following described real estate.
That part of the Northeast Quarter of Section 31,
Township 31 North, Range 14 East of the Fifth Principal
Meridian, in the City and* County of Cape Girardeau, State
of Missouri, described as follows:
Commence at the Southwest corner of Lot 3, Block 6,
Brucher Heights Subdivision for the point of beginning;
thence, Westwardly for a distance of 30.0 feet to the
Southeast corner of Lot 1, Monticello 2nd Addition for a
point; thence Northerly,, 172.,1 feet to the Northeast
corner of Lot 1, Monticello 2nd Addition for a point;
thence Easterly, 30.0 feet to a point on the West line of
Lot 1 &
,, Brucher Heights Subdivision, thence Southerly.,
172,1 feet along the West line of Lots 1, 2 and 3, Block
6, Brucher Heights Subdivision to the point of beginning.
Containing 5,163 square feet more or less.
is hereby vacated,, except for an easement for utility purposes
thereon.
ARTICLE 2. This ordinance shall be in full force and effect
ten days after its passage and approval.
