AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE
A QUIT CLAIM DEED TO THE MISSOURI HIGHWAY AND
TRANSPORTATION COMMISSION FOR THE LEXINGTON
AVENUE/HIGHWAY 61 INTERSECTION PROJECT
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The Mayor, for and on behalf of the City of Cape
Girardeau, Missouri, is hereby authorized to execute a Quit Claim
Deed to the Missouri Highway and Transportation Commission for the
Lexington Avenue/Highway 61 Intersection Project. A copy of said
Quit Claim Deed is attached to this Ordinance and made a part
hereof.
ARTICLE 2. This ordinance shall be in full force and effect
ten days after its passage and approval.

WITNESSETH, that the said party_ of the first, part, in consideration of the

Fifth Principal Meridian, in the City of County of Cape Girardeau,
State of Missouri, described as follows:
A tract of land designated by widths as measured at right angles from
the hereinafter described highway and city avenue centerlines is
located and described by commencing at the common corner of Sections
23, 24, 25 and 26, T. 31 N., R. 13 E., thence S. 430 28' 34" W.
2407.40 ft. to the intersection of the centerlines of highway State
Route W and Lexington Avenue where Route W centerline Sta. 500+17.77
equals Lexington Avenue centerline Sta. 5+91.26, thence N. 220 57, 56"
W. 162.13 ft. to a point in the east existing highway right of way
line of State Route W being 35 ft. northeast of State Route W highway
centerline Sta. 498+59.4 and 143.37 ft. northwest of Lexington Avenue
Centerline Sta. 6+66.96 for the point of beginning; thence on and
along the north city street right of way line of Lexington Avenue as
follows: S. 880 061 48" E. 95.37 ft. to a point 67.52 ft. northwest
of Lexington Avenue Centerline Sta. 7+24.77, thence N. 440 04' 28" E.
55.43 ft. to a point 62.81 ft. northwest of Lexington Avenue
Centerline Sta. 7+80, thence S. 500 48' 00" E. perpendicular to
Lexington Avenue centerline 129.81 ft. to a point in the south city
street right of way line of Lexington Avenue being 67.00 ft. southeast

south city street right of way of Lexington Avenue as follows: S. 330
26' 53" W. 106.00 ft. to a point 77.55 ft. southeast of Lexington
Avenue Centerline Sta. 6+74.52, thence S. 10 53' 04" W. 100.79 ft. to
a point in the east highway right of way line of State Route W being
39.7 ft. northeast of State Route W highway centerline Sta. 501+50.6
and 138.65 ft. southeast of Lexington Avenue Centerline Sta. 5+94.36,
thence N. 360 21' 50" W. on and along the east highway right of way
line of State Route W a distance of 291.22 ft. to the point of
beginning, containing 0.60 of an acre.
The above referenced highway centerline of State Route W is located
and described by commencing at the common corner of Sections 23, 24,
25 and 26, T. 31 N., R. 13 E., thence S. 430 28' 34" W. 2407.40 ft. to
a point in the highway centerline of State Route W being Sta.
500+17.77 for the point of beginning; thence the highway centerline of
State Route W extends N. 350 26' W. a distance of 158.37 ft. to Sta.
498+59.4 and from point of beginning Sta. 500+17.77 the highway
centerline of State Route W extends S. 350 26' E. a distance of 132.83
ft. to Sta. 501+50.6.
The above referenced centerline of Lexington Avenue is located and
described by commencing at Sta. 500+17.77 on the above described
highway centerline of State Route W which equal to Lexington Avenue
Centerline Sta. 5+91.26 for the point of beginning; thence the
centerline of Lexington Avenue extends N. 390 12' E. 188.74 ft. to
Sta. 7+80.
Grantor hereby conveys all acquired rights, control and reservation of
access to that portion of now known Lexington Avenue located within
the herein conveyed land to Grantee.

immunities thereto belonging or in anywise appertaining, unto said party of the
