AN ORDINANCE ACCEPTING PERMANENT EASEMENTS FOR
A SANITARY SEWER FROM DRURY LAND DEVELOPMENT,
INC.; AND DRURY INNS, INC.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a Permanent Easement executed by Drury Land Development,
Inc., a Missouri Corporation, conveying to the City of Cape
Girardeau, Missouri, a Permanent Easement for the maintenance of a
sanitary sewer line, described as follows, to -wit:
A part of Lot No. 1 of Commissioners Plat of Subdivision of United
States Private Survey Number 3090, Township 30 North, Range 13 East
of the Fifth Principal Meridian, City and County of Cape Girardeau,
State of Missouri, being more particularly described as follows:
A strip of land being 10.00 feet wide for the maintenance of a
sanitary sewer line from Drury Land Development, Inc. in favor of
the City of Cape Girardeau, Missouri.
Commencing at the southeast corner of Lot No. 16 of Cape West Fifth
Subdivision as recorded in the land records of the County Recorders
Office in Plat Book No. 17 at Page No. 26, from which point the
southwest corner of said lot bears South 680 15' 00" West, 462.61
feet, said southeast corner being on the westerly right of way line
of. Cape West Parkway; thence along said right of way line the
following course and distances: South 300 37' 50" East, 365.64 feet
to the beginning of a curve concave to the southwest having a
central angle of. 08" 52' 50" and a radius of 565.00 feet; thence
along said curve in a southeasterly direction 87.57 feet; thence
North 680 15' 00" East, 10.00 feet; thence South 21" 45' 00" East,
11.52 feet; thence leaving said right of way line, South 68" 15' 00"
West, 456.83 feet to the true point of beginning; thence continuing
South 68" 15' 00" West 186.73 feet; thence North 660 45' 00" West,
14.14 feet; thence North 68" 15' 00" East, 196.73 feet; thence South
210 45' 00" East, 10.00 feet to the true point of beginning,
containing 0.04 acres (1,917.27 square feet), more or less.
ARTICLE 2. The City of Cape Girardeau, Missouri, hereby
accepts a Permanent Easement executed by Drury Inns, Inc., a
Missouri Corporation, conveying to the City of Cape Girardeau,
Missouri, a Permanent Easement for the maintenance of a sanitary
sewer line, described as follows, to -wit:

southwest corner of said lot bears South 680 15' 00" West, 462.61

South 68" 15' 00" West, 10.00 feet; thence North 21" 45' 00" West,
173.40 feet; thence North 680 15' 00" East, 10.00 feet; thence South
210 45' 00" East, 173.40 feet to the true point of beginning,
containing 0.039 acres (1,734.00 square feet), more or less.
ARTICLE 3. This ordinance shall be in full force and effect
ten days after its passage and approval.
