BILL NO. 95-280 ORDINANCE NO. 3--�
AN ORDINANCE ACCEPTING A GENERAL WARRANTY
DEED, A PERMANENT EASEMENT, AND A TEMPORARY
CONSTRUCTION EASEMENT FROM KASTEN CONCRETE
PRODUCTS, INC. FOR THE WASTEWATER TREATMENT
PLANT ACCESS PROJECT
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a General Warranty Deed executed by Kasten Concrete
Products, Inc., a Missouri corporation, conveying to the City of
Cape Girardeau, Missouri, a General Warranty Deed for the
Wastewater Treatment Plant Access Project, more particularly
described as follows, to -wit:
Part of Lots 1, 2, 3, 4, 5, 6 and 7 in Block 3 in the Village of
Leadville Subdivision, as recorded in Plat Book 2 on Page 41 in the
Cape Girardeau County office of the Recorder in Jackson, Missouri,
being in the County and City of Cape Girardeau, Missouri, more
particularly described as follows:
Tract 1:
All of the West 23 feet of said Lots 1, 2, 3, 4, 5, and 6 in Block
3 of the Village of Leadville Subdivision.
Tract 2:
Commencing at the Northwest corner of said Lot 1 in Block 3 of the
Village of Leadville Subdivision, also being the intersection of the
East right of way line of Third Street and the South right of way
line of Locust Street; thence easterly 23 feet along the North line
of said Lot 1 to the point of beginning; thence southerly, parallel
to the West line of said Lot 1, 20 feet to a point as measured
perpendicular 23 feet from the West line of said Lot 1; thence
northeasterly 40 feet to a point on the North line of said Lot 1;
thence westerly 35 feet along the North line of said Lot 1 to the
point of beginning.
Tract 3:
Commencing at the Southwest corner of said Lot 6 in Block 3 of the
Village of Leadville Subdivision, also being the intersection of the
East right of way line of Third Street and the North right of way
line of Cooper Street; thence easterly 23 feet along the South line
of said Lot 6 to the point of beginning; thence northerly, parallel
to the West line of said Lot 6, 51.66 feet to a point in the North
line of said Lot 6; thence southeasterly 56.57 feet to a point as
measured perpendicular 61 feet from the West line of said Lot 6 and
13 feet from the North line of said Lot 6; thence easterly, parallel
to the North line of said Lot 6, 77 feet to a point on the East line
of said Lot 6; thence southerly 13 feet to a point on the South line
of said Lot 6; thence westerly 116 feet along the South line of said
Lot 6 to the point of beginning.
Tract 4:
Beginning at the Southwest corner of said Lot 7 in Block 3 of the
Village of Leadville Subdivision, also being on the North right of
way line of Cooper Street; thence northerly, along the West line of
said Lot 7, 13 feet to a point; thence easterly, parallel to the
South line of said Lot 7, 23.9 feet to a point; thence southerly 13
feet to a point on the South line of said Lot 7; thence westerly
23.9 feet along the South line of said Lot 7 to the point of
beginning.
ARTICLE 2. The City of Cape Girardeau, Missouri, hereby
accepts a Permanent Easement executed by Kasten Concrete Products,
Inc., a Missouri corporation, conveying to the City of Cape
Girardeau, Missouri, a Permanent Easement for the Wastewater
Treatment Plant Access Project, more particularly described as
follows, to -wit:
Tract 5:
Part of Lots 1, 2, 3, 4, 5, 6 and 7 in Block 3 in the Village of
Leadville Subdivision, as recorded in Plat Book 2 on Page 41 in the
Cape Girardeau County Office of the Recorder in Jackson, Missouri,
being in the County and City of Cape Girardeau, Missouri, more
particularly described as follows:
All of the West 36 feet of said Lots 1, 2, 3, 4, and 5 in Block 3,
and all of the West 36 feet and South 27 feet of said Lot 6 in Block
3 in the Village of Leadville Subdivision, as recorded in Plat Book
2 on Page 41, except that part described as Warranty Deed Tracts 1,
2, 3 and 4 above.
Tract 6:
Part of Out Lot 65 in U.S.P. Survey 2199 in the City and County of
Cape Girardeau, Missouri, as recorded in Book 163 on Page 530 in the
Cape Girardeau Office of the Recorder in Jackson, Missouri, and more
particularly described as follows:
Commencing at the intersection of the South line of Block 3 of the
Village of Leadville and the East right of way line of the former
Missouri Pacific Railroad; thence South 30 feet along the East right
of way line of the said Missouri Pacific Railroad; thence East 60
feet parallel to the South line of Block 3 of the Village of
Leadville Subdivision to a corner of the tract, said corner being
the point of beginning; thence East 17 feet from the point of
beginning and parallel to the South line of said Block 3 to a point;
thence South 150 feet parallel to the East right of way line of the
said Missouri Pacific Railroad to a point in the South line of the
tract; thence West 17 feet along the South line of the tract to the
Southwest corner of the tract; thence North 150 feet along the West
line of the tract and parallel to the East right of way line of the
said Missouri Pacific Railroad to the point of beginning, containing
2,550 square feet, more or less.
ARTICLE 3. The City of Cape Girardeau, Missouri, hereby
accepts a Temporary Construction Easement executed by Kasten
Concrete Products, Inc., a Missouri corporation, conveying to the
City of Cape Girardeau, Missouri, a Temporary Construction Easement
for the Wastewater Treatment Plant Access Project, more
particularly described as follows, to -wit:
Tract 7:
Part of Lot 8 in Block 3 in the Village of Leadville Subdivision in
the County and City of Cape Girardeau, Missouri as recorded in Plat
Book 2 on Page 41, and part of Out Lot 65 in U.S.P. Survey 2199 in
the County and City of Cape Girardeau, Missouri, as recorded in Plat
Book 163 on Page 530 in the Cape Girardeau County Office of the
Recorder in Jackson, Missouri, more particularly described as
follows:

Beginning at a point at the intersection of the South line of said
Block 3 of the Village of Leadville Subdivision and the East right
of way line of the former Missouri Pacific Railroad; thence North 25
feet along the East right of way line of the said Missouri Pacific
Railroad to a point; thence East 90 feet parallel to the South line
of said Block 3 to a corner of the tract; thence South 55 feet
parallel to the East right of way line of the said Missouri Pacific
Railroad to a point in the South line of the tract; thence West 30
feet parallel to the South line of said Block 3 to a point in the
South right of way of Cooper Street; thence North 30 feet
perpendicular to the South right of way line of Cooper Street and
parallel to the East right of way line of the said Missouri Pacific
Railroad to a point in the North right of way line of Cooper Street,
same point being in the South line of said Block 3; thence West 60
feet along the South line of said Block 3 to the point of beginning,
containing 3,150 square feet, more or less.
ARTICLE 4. This ordinance shall be in full force and effect
ten days after its passage and approval.
