ORDINANCE NO. 03D
AN ORDINANCE ACCEPTING A WATERLINE EASEMENT
FROM ROBERT A. DRURY AND ANNA R. DRURY, IN
ETHERTON SUBDIVISION
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a Waterline Easement, executed by Robert A. Drury and Anna
R. Drury, husband and wife, conveying to the City of Cape
Girardeau, Missouri, a Waterline Easement in Etherton Subdivision,
more particularly described as follows, to -wit:
A part of Lots 1 to 5 of Etherton Subdivision, located in United States Private Survey No, 2199, Township 30 North,
Range 13 East of the Fifth Principal Meridian, City and County of Cape Girardeau, State of Missouri, being more
particularly described as follows:
A strip of land being 5.00 feet wide for the construction and maintenance of a waterline from Robert A. Drury and Anna
R. Drury, his wife in favor of the City of Cape Girardeau, Missouri.
Beginning at a point on the East line of Lot No. 5 of Etherton Subdivision as recorded in the land records of the County
Recorders Office in Plat Book No. 18 at Page No. 24, from which point the Northeast corner of said lot bears North 14o
04' 43" West, 97.74 feet, said point being the beginning of a non -tangent curve concave to the Southeast having a central
angle of 750 47' 06" and a radius of 57.00 feet, from which point a radial line bears, South 14o 04' 43" East; thence along
said curve in a Southwesterly direction 75.39 feet; thence South 00o 08' 10" West, 358.34 feet to a point on the Westerly
right-of-way line of Etherton Drive, said point being the beginning of a non -tangent curve concave to the Northwest,
having a central angle of 410 24' 35" and a radius of 20.00 feet, from which point a radial line bears, North 480 27' 15"
West; thence along said curve and right-of-way line in a Northeasterly direction, 14.45 feet; thence continuing along said
right-of-way line, North 00o 08' 10" East, 345.11 feet to the beginning of a curve concave to the Southeast, having a
central angle of 750 47' 06" and a radius of 52.00 feet; thence along said curve in a Northeasterly direction, 68.78 feet
to the Southeast corner of Lot No. 5 of said subdivision; thence leaving said right-of-way line and along the East line of
said Lot No. 5, North 14o 04' 43" West, 5.00 feet to the Point of Beginning, containing 0.05 acres more or less.
ARTICLE 2. This ordinance shall be in full force and effect
ten days after its passage and approval.
