AN ORDINANCE ACCEPTING PERMANENT EASEMENTS AND
TEMPORARY CONSTRUCTION EASEMENTS FROM DONALD
J. BERG; CAPE GIRARDEAU PROPERTIES, L.P.;
FREDERICK TYRE ENDEAN AND DIANE MARIE ENDEAN;
BRENT A. KING AND BARBARA A. KING; DANA MYER;
ANN W. RITTER, TRUSTEE; DOROTHY M. SIGMUND,
TRUSTEE AND CATHERINE BRAUN JORDAN AND WILLIAM
C. JORDAN; CHARLEY WILLIAMS; AND OSIE WILLIAMS
AND CORNILUS WILLIAMS; AND ACCEPTING PERMANENT

PLAN FOR SANITARY SEWER IMPROVEMENT PROGRAM.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a Permanent Easement executed by Donald J. Berg, conveying
to the City of Cape Girardeau, Missouri, a Permanent Easement for
the Phase I Facility Plan for Sanitary Sewer Improvement Program,
more particularly described as follows, to -wit:
Begin at the Northwest corner of Lot 12 in Block 14 of West End
Place Addition; thence South 83' 51' 001, East, with the north line
of said Lot 12, 10.00 feet; thence South 061 08, 42" West, 55.00
feet; thence North 830 51, 00" West, with the South line of said
Lot, 10.00 feet; thence North 060 08, 42" East, with the West line
of said Lot, 55.00 feet, to the place of beginning and containing
550 square feet, more or less.
ARTICLE 2. The City of Cape Girardeau, Missouri, hereby
accepts a Temporary Construction Easement executed by Donald J.
Berg, conveying to the City of Cape Girardeau, Missouri, a
Temporary Construction Easement for the Phase I Facility Plan for
Sanitary Sewer Improvement Program, more particularly described as
follows, to -wit:
Commence at the Northwest corner of Lot 12 in Block 14 of West End
Place Addition; thence South 83' 51' 0011 East, with the North line
of said Lot 12, 10.00 feet, to the place of beginning; thence South
060 08, 4211 West, 55.00 feet; thence South 831 511 001, East, with
the South line of said Lot, 5.00 feet; thence North 061 08,4211 East,
55.00 feet; thence North 830 51, 00" West, with the North line of
said Lot, 5.00 feet, to the place of beginning and containing 275
square feet, more or less.
ARTICLE 3. The City of Cape Girardeau, Missouri, hereby
accepts a Permanent Easement executed by Cape Girardeau Properties,
L.P., conveying to the City of Cape Girardeau, Missouri, a
Permanent Easement for the Phase I Facility Plan for Sanitary Sewer
Improvement Program, more particularly described as follows, to -

All of that part of Outlot 52 of a part of United States Private
Survey Number 2199, Township 30 North, Range 14 East, of the Fifth
Principal Meridian, in the City and County of Cape Girardeau, State
of Missouri, described as follows:
From the Northwest corner of Outlot 52 measure South 060 44' West,
along and with the West line thereof a distance of 575.0 feet to the
Easterly line of an existing easement; said easement being recorded
in Book 78 at Page 83 of the Cape Girardeau County Deed Records,
thence along and with said Easterly line and a curve to the right
having a radius of 956.9 feet, a central angle of 021 57' and a
chord bearing of North 440 11' East, an arc distance of 49.4 feet to
the East right of way line of West End Boulevard and the point of

Plan for Sanitary Sewer Improvement Program, more particularly
described as follows, to -wit:
Begin at the Southwest corner of said Lot No. 8; thence North 541
54' 57" East, 130.22 feet, with the West line of said Lot 8, to the
Northwest corner of said Lot No. 8, being on the South line of
Montgomery Court, along the arc of a curve to the left and having a

Facility Plan for Sanitary Sewer Improvement Program, more
particularly described as follows, to -wit:

Subdivision of part of outlot 28 of U.S.P. Survey No. 2199; thence
South 061 22' 11" West, with the East line of said Block 1, 149.60
feet, to the place of beginning; thence South 71° 19' 15" West,

Jordan, her husband, conveying to the City of Cape Girardeau,
Missouri, a Permanent Easement for the Phase I Facility Plan for
Sanitary Sewer Improvement Program, more particularly described as
