AN ORDINANCE AMENDING CHAPTER 26 OF THE CITY
CODE RELATING TO WEARING PROTECTIVE HEADGEAR
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. Section 26-346 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, entitled "Same --Helmet Required",
reading as follows:
Sec. 26-346. Same --Helmet required.
Every person operating, or riding as a passenger on
any motorcycle, as defined in RSMo 301.010, anywhere
within the city limits shall wear protective headgear at
all times that the vehicle is in motion. The headgear
shall meet reasonable standards and specifications
established by the state director of the department of
public safety.
is hereby repealed in its entirety, and a new Section 26-346
entitled "Same --Helmet Required", is hereby enacted in lieu
thereof, in words and figures, to read as follows:
Sec. 26-346. Same --Helmet required.
(a) Every person operating, or riding as a passenger on
any motorcycle, as defined in RSMo 301.010,
anywhere within the city limits shall wear
protective headgear at all times that the vehicle
is in motion. The headgear shall meet reasonable
standards and specifications established by the
state director of the department of public safety.
(b) The maximum penalty for a violation of the
provisions of this section is Twenty -Five Dollars
($25.00). No court costs shall be imposed upon any
person due to such violation.
ARTICLE 2. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof.
ARTICLE 3. It is the intention of the governing body and it
is hereby ordained that the provisions of this ordinance shall
become and be made a part of the Code of Ordinances of the City of
Cape Girardeau, Missouri, and the sections of this Code may be
renumbered to accomplish such intention.
ARTICLE 4. Pursuant to Section 3.15 of the Charter of the
City of Cape Girardeau, Missouri, this measure is adopted as an
emergency measure as it constitutes a Bill concerning the immediate
preservation of public peace, property, health, safety or morals.
Accordingly, this ordinance will take effect immediately upon its
passage and approval.
