AN ORDINANCE ACCEPTING GENERAL WARRANTY DEEDS
FROM BETTY J. DIETIKER; JAMES E. PALMER; AND
JUANITA M. RATLIFF; ACCEPTING GENERAL WARRANTY
DEEDS AND TEMPORARY CONSTRUCTION EASEMENTS
FROM PETER E. COOPER AND WANETA L. COOPER; AND
ACCEPTING A PERMANENT EASEMENT AND A TEMPORARY
CONSTRUCTION EASEMENT FROM SIX THIRTY
CORPORATION, INC. FOR THE SOUTH SPRIGG STREET
ELEVATION PROJECT
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a general warranty deed executed by Betty J. Dietiker, AKA
Betty J. Deitiker, a single person, conveying to the City of Cape
Girardeau, Missouri, a general warranty deed for the South Sprigg
Street Elevation Project, more particularly described as follows,
to -wit:
Lots 1 and 2, Block 1 and Lots 4, 5, 6 and 7, Block 2 in
Smelterville in the City and County of Cape Girardeau, State of
Missouri, as recorded in Plat Book 2 at page 42.
ARTICLE 2. The City of Cape Girardeau, Missouri, hereby
accepts a general warranty deed executed by James E. Palmer,
surviving spouse of Mary M. Palmer, deceased July 17, 1993,
conveying to the City of Cape Girardeau, Missouri, a general
warranty deed for the South Sprigg Street Elevation Project, more
particularly described as follows, to -wit:
A11 of Lot Four (4) in Block One (1) and the North 5 feet and 4
inches of Lot Five (5) in Block one (1) of Smelterville in the City
and County of Cape Girardeau, State of Missouri, recorded in Plat
Book 2 at page 42.
ARTICLE 3. The City of Cape Girardeau, Missouri, hereby
accepts a general warranty deed executed by Juanita M. Ratliff, a
single person, conveying to the City of Cape Girardeau, Missouri,
a general warranty deed for the South Sprigg Street Elevation
Project, more particularly described as follows, to -wit:
Lots 2 and 3, Block 2 in Smelterville in the City and County of Cape
Girardeau, State of Missouri, as recorded in Plat Book 2 at page 42.
ARTICLE 4. The City of Cape Girardeau, Missouri, hereby
accepts a general warranty deed executed by Peter E. Cooper and
Waneta L. Cooper, husband and wife, conveying to the City of Cape
Girardeau, Missouri, a general warranty deed for the South Sprigg
Street Elevation Project, more particularly described as follows,
to -wit:
Part of Lots 2 and 3 in Block 4 of Smelterville in the County and
City of Cape Girardeau, Missouri. More particularly described as
follows.
Commencing at the Northwest Corner of a tract of land owned by the
Lohmann Family Trust as recorded in Book 510 on Page 478 in the
office of the recorder in Jackson, Missouri also being the Northwest
Corner of Lot 1 of Block 4 of Smelterville, said corner being in the
East Line of Old Sprigg Street and the South Line of Poplar Street;
thence South 28 degrees, 3 minutes, 44 seconds West, along the East
Line of said Old Sprigg Street, 33.4 feet to the Northwest Corner of
Lot 2, being the point of beginning: thence leaving said east line
of Old Sprigg Street, South 83 degrees, 1 minutes, 3 seconds East,
along the south line of Lot 1, 9.11 feet to a point; thence South 28
degrees, 3 minutes, 44 seconds West, 50.16 feet to a point; thence
South 5 degrees, 28 minutes, 10 seconds East, 15.76 feet to a point
in the south line of Lot 3; thence North 83 degrees, 3 minutes, 23
seconds West, along the south line of said Lot 3, 18.44 feet to the
Southwest Corner of said Lot 3 in the east line of said Old Sprigg
Street; thence North 28 degrees, 3 minutes, 44 seconds East, along
said East Line of Old Sprigg Street, 66.66 feet to the point of
beginning, and containing 638 square feet.
ARTICLE 5. The City of Cape Girardeau, Missouri, hereby
accepts a general warranty deed executed by Peter E. Cooper and
Waneta L. Cooper, husband and wife, conveying to the City of Cape
Girardeau, Missouri, a general warranty deed for the South Sprigg
Street Elevation Project, more particularly described as follows,
to -wit:
Part of Lots 4, 5 and 6 of Block 3 of Smelterville in the County and
City of Cape Girardeau, Missouri, more particularly described as
follows:
Beginning at the Southwest Corner of a tract of land owned by Peter
and Waneta Cooper as recorded in Book 438 on Page 179 in the office
of the Recorder in Jackson, Missouri also being the Southwest Corner
of Lot 6 of Block 3 of Smelterville in the County and City of Cape
Girardeau, Missouri in the east right of way line to Old Sprigg
Street; thence North 28 degrees, 3 minutes, 44 seconds East, along
said east right of way, 99.99 feet to the Northwest Corner of Lot 4
in said Block 3; thence leaving said east right of way, South 82
degrees, 8 minutes, 34 seconds East, 9.06 feet to a point; thence
South 28 degrees, 3 minutes, 44 seconds West, 59.65 feet to a point;
thence South 31 degrees, 25 minutes, 59 seconds East, 48.90 feet to
a point in the south line of said Lot 6 in said Block 3; thence
North 82 degrees, 9 minutes, 36 seconds West, along said south line
of Lot 6, 53.95 feet to the point of beginning, and containing 1,700
square feet.
ARTICLE 6. The City of Cape Girardeau, Missouri, hereby
accepts a temporary construction easement executed by Peter E.
Cooper and Waneta L. Cooper, husband and wife, conveying to the
City of Cape Girardeau, Missouri, a temporary construction easement
for the South Sprigg Street Elevation Project, more particularly
described as follows, to -wit:
Part of Lots 2 and 3 in Block 4 of Smelterville in the County and
City of Cape Girardeau, Missouri. More particularly described as
follows.

Commencing at the Northwest Corner of a tract of land owned by the

accepts a temporary construction easement executed by Peter E.
Cooper and Waneta L. Cooper, husband and wife, conveying to the
City of Cape Girardeau, Missouri, a temporary construction easement
for the South Sprigg Street Elevation Project, more particularly
described as follows, to -wit:
Part of Lots 4, 5 and 6 of Block 3 of Smelterville in the County and
City of Cape Girardeau, Missouri, more particularly described as
follows:
Commencing at the Southwest Corner of a tract of land owned by Peter
and Waneta Cooper as recorded in Book 438 on Page 179 in the office
of the recorder in Jackson, Missouri, also being the Southwest
Corner of Lot 6 of Block 3 of Smelterville in the County and City of
Cape Girardeau, Missouri, in the east right of way line to 0ld
Sprigg Street; thence North 28 degrees, 3 minutes, 44 seconds East,
along said east right of way, 99.99 feet to the Northwest Corner of
Lot 4 in said Block 3; thence leaving said east right of way, South
82 degrees, 8 minutes, 34 seconds East, 9.06 feet to the point of
beginning; thence continuing South 82 degrees, 8 minutes, 34 seconds
East, along the North line of said Lot 4 in Block 3, 14.92 feet to

accepts a temporary construction easement executed by Peter E.
Cooper and Waneta L. Cooper, husband and wife, conveying to the
City of Cape Girardeau, Missouri, a temporary construction easement
for the South Sprigg Street Elevation Project, more particularly
described as follows, to -wit:
Part of Lot 2 of Block 4 of Smelterville in the County and City of
Cape Girardeau, Missouri, more particularly described as follows:
The north ten (10) feet of Lot 2, Block 4 of Smelterville owned by
Peter E. and Waneta L. Cooper as recorded in Book 750 on Page 732 in
the Office of the Recorder, in Jackson, Missouri.

ARTICLE 9. The City of Cape Girardeau, Missouri, hereby
accepts a permanent easement executed by Six -Thirty Corporation,
Inc., a Missouri Corporation, conveying to the City of Cape
Girardeau, Missouri, a permanent easement for the South Sprigg
Street Elevation Project, more particularly described as follows,
to -wit:
Tract 1:
Part of Out Lot 63 in U.S. Survey 2199 in Township 30 North, Range
14 East of the Fifth Principal Meridian in the County and City of
Cape Girardeau, Missouri. More particularly described as follows.
Beginning at the Northeast Corner of a tract of land owned by Six
Thirty Inc. as recorded in Book 487 on Page 356 in the office of the
recorder in Jackson Missouri; thence South 28 degrees, 3 minutes, 44
seconds West, along the west right of way to Old Sprigg Street,
15.03 feet to a point; thence North 61 degrees, 56 minutes, 16
seconds West, 15.00 feet to a point; thence South 28 degrees, 3
minutes, 44 seconds West, 40.15 feet to a point; thence South 73
degrees, 3 minutes, 44 seconds West, 102.60 feet to a point; thence
leaving said right of way North 33 degrees, 20 minutes, 56 seconds
East, 99.13 feet to a point in the north line of the aforesaid Six
Thirty tract; thence South 82 degrees, 15 minutes, 0 seconds East,
along said north line of Six Thirty tract, 83.61 feet to the point
of beginning. Containing 5,006 square feet.

East, 4.93 feet to a point; thence North 27 degrees, 53 minutes, 46
seconds East, 21.49 feet to a point; thence South 61 degrees, 56
minutes, 16 seconds East, 15.00 feet to a point; thence North 27
degrees, 53 minutes, 46 seconds East, 80.00 feet to a point; thence

square feet.
ARTICLE 10. The City of Cape Girardeau, Missouri, hereby
accepts a temporary construction easement executed by Six Thirty
Corporation, Inc., a Missouri Corporation, conveying to the City of
Cape Girardeau, Missouri, a temporary construction easement for the
South Sprigg Street Elevation Project, more particularly described
as follows, to -wit:

ARTICLE 11. This ordinance shall be in full force and effect
ten days after its passage and approval.
