AN ORDINANCE ACCEPTING A GENERAL WARRANTY DEED
AND A TEMPORARY ACCESS EASEMENT FROM YEWELL
KRAUST AND VIRGIE KRAUST FOR THE WASTEWATER
TREATMENT PLANT ACCESS PROJECT
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a Special Warranty Deed executed by Yewell Kraust and
Virgie Kraust, husband and wife, conveying to the City of Cape
Girardeau, Missouri, a Special Warranty Deed for the Wastewater
Treatment Plant Access Project, more particularly described as
follows, to -wit:
All of that part of Outlot 65, United States Private
Survey Number 2199, Township 30 North, Range 14 East of
the Fifth Principal Meridian, City of Cape Girardeau,
Cape Girardeau County, Missouri, described as follows:
From the Northeast corner of the United States Private
Survey No. 2202 measure North 83' 00' West, a distance of
92.0 feet to the East right-of-way line of the St. Louis
and San Francisco Railroad; thence North 290 40' East,
along and with said right-of-way line, a distance of
779.23 feet; thence South 340 58' 3911 East, a distance of
303.76 feet; thence North 550 01' 2111 East, a distance of
391.99 feet to the Northeast corner of property described
in Book 502 at Page 821 of the Cape Girardeau County Deed
Records and the point of beginning; thence North 820 00°
West, along and with the North line of said described
property, a distance of 138.1 feet; thence South 080 00'
West, a distance of 30.0 feet; thence South 820 001 East,
a distance of 105.94 feet to the East line of property
described in Book 502 at Page 821 of the Cape Girardeau
County Deed Records; thence North 550 01' 2111 East, along
and with said East line a distance of 44.01 feet to the
point of beginning and containing 3,661 square feet, more
or less, subject to existing easements and right-of-ways.
ARTICLE 2. The City of Cape Girardeau, Missouri, hereby
accepts a Temporary Access Easement executed by Yewell Kraust and
Virgie Kraust, husband and wife, conveying to the City of Cape
Girardeau, Missouri, a Temporary Access Easement for the Wastewater
Treatment Plant Access Project, more particularly described as
follows, to -wit:
That part of Out Lots No. 63 and 65 to the City of Cape
Girardeau, County of Cape Girardeau, State of Missouri,
described as follows:
Commence at the Northeast Corner of U.S.P. Survey No.
2202; thence North 830 00' West, 92.0 feet, to a point on
the East line of the St. Louis and San Francisco Railroad
right of way; thence North 290 40' East, with said East
line 779.23 feet, to the place of beginning; thence
continue with said East line, North 290 40' East, 48.41
feet, to a point on the center line of Cooper Street;
thence with the center of said Cooper Street, South 820
00' East, 475.99 feet; thence South 550 01' 2111 West,
391.99 feet; thence North 340 58' 39" West, 303.76 feet,
to the place of beginning, and containing 1.6125 acres,
more or less, save and except that area which is occupied
by the building.
ARTICLE 3. This ordinance shall be in full force and effect
ten days after its passage and approval.
