ORDINANCE NO. /759
AN ORDINANCE AMENDING SCHEDULE G OF SECTION
26-249 BY REPEALING TWO HOUR PARKING; AND
AMENDING SCHEDULE F OF SECTION 26-247, BY
ENACTING NO PARKING, IN THE CITY OF CAPE
GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. Schedule G of Section 26-249 of the Code of
Ordinances of the City of Cape Girardeau, Missouri, is hereby
amended by repealing that portion of Ordinance No. 1370, passed and
adopted July 7, 1993, which established a two hour parking zone in
the City of Cape Girardeau, Missouri, at the following location:
Henderson Avenue, along the East side, from Cheney Drive
to New Madrid Street, 6:00 a.m. to 5:00 p.m., Monday
through Friday.
ARTICLE 2. Schedule F of Section 26-247 of the Code of
Ordinances of the City of Cape Girardeau, Missouri, is hereby
amended by establishing a no parking zone in the City of Cape
Girardeau, Missouri, at the following location:
On North Henderson Street, East side, from Cheney Drive
to New Madrid Street.
ARTICLE 3. The amendments enacted in this Ordinance shall
automatically terminate when construction of the Robert A. Dempster
Hall for the Donald L. Harrison College of Business at Southeast
Missouri State University has been completed, unless extended or
renewed in accordance with law.
ARTICLE 4. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof.
ARTICLE 5. Pursuant to Section 3.15 of the Charter of the
City of Cape Girardeau, Missouri, this measure is adopted as an
emergency measure as it constitutes a Bill concerning the immediate
preservation of public peace, property, health, safety or morals.
Accordingly, this ordinance will take effect immediately upon its
passage and approval.
