AN ORDINANCE ACCEPTING A GENERAL WARRANTY
DEED, A QUIT CLAIM DEED AND A TEMPORARY
CONSTRUCTION EASEMENT FROM ANDREW E. KINNISON;
AND ACCEPTING QUIT CLAIM DEEDS AND TEMPORARY
CONSTRUCTION EASEMENTS FROM HAROLD L. GERLACH
AND MAXINE L. GERLACH; AND LINDA K. WILCOX FOR
THE LEXINGTON AVENUE EXTENSION PROJECT
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a General Warranty Deed executed by Andrew E. Kinnison and
Andrew E. Kinnison, Conservator of the Estate of Iola M. Kinnison,
conveying to the City of Cape Girardeau, Missouri, a General
Warranty Deed for the Lexington Avenue Extension Project, more
particularly described as follows, to -wit:
All of that part of the North half of the Northeast
Quarter of the Northeast Quarter of Fractional Section
30, Township 31 North, Range 14 East of the Fifth
Principal Meridian, Cape Girardeau County, Missouri,
described as follows:
From the Northwest corner of the Northeast Quarter of the
Northeast Quarter of Fractional Section 30, measure South
040 24' West, a distance of 22.2 feet; thence South 850
57' East, a distance of 20.0 feet to the point of
beginning; thence continue South 850 57' East, a distance
of 40.0 feet; thence South 490 16' West, a distance of
56.7 feet; thence North 040 24' East, a distance of 39.9
feet to the point of beginning, containing 798.9 square
feet (0.02 acres), subject to easements and rights-of-
way.
ARTICLE 2. The City of Cape Girardeau, Missouri, hereby
accepts a Quit Claim Deed executed by Andrew E. Kinnison and Andrew
E. Kinnison, Conservator of the Estate of Iola M. Kinnison,
conveying to the City of Cape Girardeau, Missouri, a Quit Claim
Deed for the Lexington Avenue Extension Project, more particularly
described as follows, to -wit:
All of that part of the North half of the Northeast
Quarter of the Northeast Quarter of Fractional Section
30, Township 31 North, Range 14 East of the Fifth
Principal Meridian, Cape Girardeau County, Missouri,
described as follows:
From the point of beginning at the Northwest Corner of
the Northeast Quarter of the Northeast Quarter of
Fractional Section 30, measure South 850 361 East, with
the North line of said Fractional Section 30, a distance
of 688.0 feet; thence South 150 24' West, a distance of
18.3 feet; thence North 850 57' West, a distance of 664.5
feet; thence South 040 24' West, a distance of 39.9 feet;
thence North 850 36' West, a distance of 20.0 feet;
thence North 040 24' East, a distance of 62.0 feet, to
the point of beginning, and containing 14,541 square
feet, more or less, subject to existing easements and
rights-of-way.
ARTICLE 3. The City of Cape Girardeau, Missouri, hereby
accepts a Temporary Construction Easement executed by Andrew E.
Kinnison and Andrew E. Kinnison, Conservator of the Estate of Iola
M. Kinnison, conveying to the City of Cape Girardeau, Missouri, a
Temporary Construction Easement for the Lexington Avenue Extension
Project, more particularly described as follows, to -wit:
All of that part of the, North Half of the Northeast
Quarter of the Northeast Quarter of Fractional Section
30, Township 31 North, Range 14 East of the Fifth
Principal Meridian, Cape Girardeau County, Missouri,
described as follows:
From the Northwest corner of the Northeast Quarter of the
Northeast Quarter of Fractional Section 30, measure South
040 24' West, a distance of 22.2 feet; thence South 850
57' East, a distance of 20.0 feet to the intersection of
the East right-of-way line of Sprigg Street and the South
right-of-way line of Melody Lane; thence continue South
850 57' East, along and with the South right-of-way line
of Melody Lane, a distance of 75.46 feet to the point of
beginning; thence South 040 24' West, a distance of 20.0
feet; thence South 850 57' East, parallel to the South
right-of-way line of existing Melody Lane, a distance of
155.5 feet, more or less to the East line of property
described in Book 466 at Page 404 in the Cape Girardeau
County Deed Records; thence Northerly, along and with
said East line, a distance of 20.0 feet, more or less, to
the South right-of-way of Melody Lane; thence North 850
57' West, along and with said right-of-way, a distance of
154.6 feet, to the point of beginning, containing 3,091.3
square feet (0.07 acres), subject to easements and
rights-of-way.
ARTICLE 4. The City of Cape Girardeau, Missouri, hereby
accepts a Quit Claim Deed executed by Harold L. Gerlach and Maxine
L. Gerlach, Trustees of the Harold L. Gerlach and Maxine L. Gerlach
Revocable Living Trust Dated October 20, 1994, conveying to the
City of Cape Girardeau, Missouri, a Quit Claim Deed for the
Lexington Avenue Extension Project, more particularly described as
follows, to -wit:

All of that part of the Northeast Quarter of the
Northeast Quarter of Fractional Section 30, Township 31
North, Range 14 East of the Fifth Principal Meridian,
Cape Girardeau County, Missouri, described as follows:
Beginning at the Northwest corner of the Northeast
Quarter of the Northeast Quarter of Fractional Section
30, thence South 850 36' East, with the North line of
said Fractional Section 30, a distance of 688.0 feet;
thence South 150 24' West, a distance of 18.3 feet;
thence North 850 57' West, a distance of 684.5 feet to a
point in the West line of said Fractional Section 30;
thence North 040 24, East, a distance of 22.1 feet, more
or less, to the point of beginning and containing 13,743
square feet, more or less.
ARTICLE 5. The City of Cape Girardeau, Missouri, hereby
accepts a Temporary Construction Easement executed by Harold L.
Gerlach and Maxine L. Gerlach, Trustees of the Harold L. Gerlach
and Maxine L. Gerlach Revocable Living Trust Dated October 20,
1994, conveying to the City of Cape Girardeau, Missouri, a
Temporary Construction Easement for the Lexington Avenue Extension
Project, more particularly described as follows, to -wit:
All of that part of the Northeast Quarter of the
Northeast Quarter of Fractional Section 30, Township 31
North, Range 14 East of the Fifth Principal Meridian,
Cape Girardeau County, Missouri, described as follows:
From the Northwest corner of the Northeast Quarter of the
Northeast Quarter of Fractional Section 30, measure South
040 24' West, a distance of 22.2 feet; thence South 850
57' East, a distance of 250.0 feet to the point of
beginning; thence continue South 850 57' East, a distance
of 140.0 feet; thence South 040 24' West, a distance of
35.0 feet; thence North 850 57' West, a distance of 140.0
feet; thence North 040 24' East, a distance of 35.0 feet,
to the point of beginning, and containing 4,900.0 square
feet, subject to existing easements and rights of -way.
ARTICLE 6. The City of Cape Girardeau, Missouri, hereby
accepts a Quit Claim Deed executed by Linda K. Wilcox, Trustee of
the Linda K. Wilcox Voluntary Trust dated October 22, 1993,
conveying to the City of Cape Girardeau, Missouri, a Quit Claim
Deed for the Lexington Avenue Extension Project, more particularly
described as follows, to -wit:
All of that part of the Northeast Quarter of the
Northeast Quarter of Fractional Section 30, Township 31
North, Range 14 East of the Fifth Principal Meridian,
Cape Girardeau County, Missouri, described as follows:

Beginning at the Northwest corner of the Northeast
Quarter of the Northeast Quarter of Fractional Section
30, thence South 850 36' East, with the North line of
said Fractional Section 30, a distance of 688.0 feet;
thence South 150 241 West, a distance of 18.3 feet;
thence North 850 57' West, a distance of 684.5 feet to a
point in the West line of said Fractional Section 30;
thence North 040 24' East, a distance of 22.1 feet, more
or less, to the point of beginning and containing 13,743
square feet, more or less.
ARTICLE 7. The City of Cape Girardeau, Missouri, hereby
accepts a Temporary Construction Easement executed by Linda K.
Wilcox, Trustee of the Linda K. Wilcox Voluntary Trust dated
October 22, 1993, conveying to the City of Cape Girardeau,
Missouri, a Temporary Construction Easement for the Lexington
Avenue Extension Project, more particularly described as follows,
to -wit:
All of that part of the Northeast Quarter of the
Northeast Quarter of Fractional Section 30, Township 31
North, Range 14 East of the Fifth Principal Meridian,
Cape Girardeau County, Missouri, described as follows:
From the Northwest Corner of the Northeast Quarter of the
Northeast Quarter of Fractional Section 30, measure South
040 24' West, a distance of 22.2 feet; thence South 85°
57' East, a distance of 440.0 feet to the point of
beginning; thence continue South 850 57' East, a distance
of 150.0 feet; thence South 040 24' West, a distance of
64.0 feet; thence North 850 57' West, a distance of 150.0
feet; thence North 040 24' East, a distance of 64.0 feet,
to the point of beginning, and containing 9,600.0 square
feet (0.22 acres), subject to existing easements and
rights-of-way.
ARTICLE 8. This ordinance shall be in full force and effect
ten days after its passage and approval.
