AN ORDINANCE ACCEPTING A QUIT CLAIM DEED AND A
TEMPORARY CONSTRUCTION EASEMENT FROM EARL Q.
ALLEN AND MARY LEE ALLEN; AND ACCEPTING A
TEMPORARY CONSTRUCTION EASEMENT FROM VERNON T.
UHRHAN AND JERRY J. UHRHAN FOR THE LEXINGTON
AVENUE EXTENSION PROJECT
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a Quit Claim Deed executed by Earl Q. Allen and Mary Lee
Allen, husband and wife, conveying to the City of Cape Girardeau,
Missouri, a Quit Claim Deed for the Lexington Avenue Extension
Project, more particularly described as follows, to -wit:
All of that part of the Northeast Quarter of the
Northeast Quarter of Fractional Section 30, Township 31
North, Range 14 East of the Fifth Principal Meridian,
Cape Girardeau County, Missouri, described as follows:
Beginning at the Northwest corner of the Northeast
Quarter of the Northeast Quarter of Fractional Section
30, thence South 850 36' East, with the North line of
said Fractional Section 30, a distance of 688.0 feet;
thence South 150 24' West, a distance of 18.3 feet;
thence North 850 57' West, a distance of 684.5 feet to a
point in the West line of said Fractional Section 30;
thence North 040 24' East, a distance of 22.1 feet, more
or less, to the point of beginning and containing 13,743
square feet, more or less.
ARTICLE 2. The City of Cape Girardeau, Missouri, hereby
accepts a Temporary Construction Easement executed by Earl Q. Allen
and Mary Lee Allen, husband and wife, conveying to the City of Cape
Girardeau, Missouri, a Temporary Construction Easement for the
Lexington Avenue Extension Project, more particularly described as
follows, to -wit:
All of that part of the Northeast Quarter of the
Northeast Quarter of Fractional Section 30, Township 31
North, Range 14 East of the Fifth Principal Meridian,
Cape Girardeau County, Missouri, described as follows:
From the Northwest Corner of the Northeast Quarter of the
Northeast Quarter of Fractional Section 30, measure South
040 24' West, a distance of 22.2 feet; thence South 850
57' East, a distance of 590.0 feet to the point of
beginning; thence continue South 850 57' East, a distance
of 94.5 feet; thence South 150 24' West, a distance of
51.0 feet; thence North 850 57' West, a distance of 84.8
feet; thence North 040 241 East, a distance of 50.0 feet
to the point of beginning, and containing 4,481.8 square
feet, more or less, subject to existing easements and
rights-of-way.
ARTICLE 3. The City of Cape Girardeau, Missouri, hereby
accepts a Temporary Construction Easement executed by Vernon T.
Uhrhan and Jerry J. Uhrhan, husband and wife, conveying to the City
of Cape Girardeau, Missouri, a Temporary Construction Easement for
the Lexington Avenue Extension Project, more particularly described
as follows, to -wit:
All of that part of the Northwest Quarter of the
Northwest Quarter of Fractional Section 29, Township 31
North, Range 14 East, Cape Girardeau County, Missouri,
described as follows:
From the Northwest corner of the Northwest Quarter of the
Northwest Quarter of Fractional Section 29, measure South
840 59' East, along and with the North line of said
Section, a distance of 757.1 feet; thence South 050 01'
West, a distance of 25.0 feet to the point of beginning;
thence South 840 59' East, a distance of 128.1 feet;
thence South 050 36' West, a distance of 55.0 feet;
thence North 840 591 West, a distance of 127.5 feet, more
or less, to the West line of the Uhrhan tract; thence
North 050 01' East, along and with the said West line, a
distance of 55.0 feet to the point of beginning, and
containing 7,001.8 square feet, subject to easements and
rights-of-way.
ARTICLE 4. This ordinance shall be in full force and effect
ten days after its passage and approval.
