HomeMy WebLinkAboutOrd.2252.10-20-1997BILL NO. 97-197 ORDINANCE NO. dJQ AN ORDINANCE AMENDING CHAPTER 30 OF THE CITY CODE RELATING TO HALFWAY HOUSES BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: ARTICLE 1. Section 30-2 of the Code of Ordinances of the City of Cape Girardeau, Missouri, entitled "Definitions", is hereby amended by the addition and enacting of one (1) new definition, in words and figures, to read as follows: Sec. 30-2. Definitions. Halfway house means a facility for rehabilitation of persons who are prisoners or former prisoners, in a controlled environment with supervision, treatment or counseling provided on-site on an interim basis after referral from a public agency or institutional facility. ARTICLE 2. Section 30-39 of the Code of Ordinances of the City of Cape Girardeau, Missouri, is hereby amended by enacting a new Section 30-39 (d) (37) , in words and figures, to read as follows: Sec. 30-39. Special use regulations. -(d) Special- useso - - - (37) Halfway houses for the rehabilitation of adult persons who are prisoners or former prisoners, may only be located in C-1, C-2, C-3, M-1, M- 2, and A-1 zones, and, if approved, are subject to the following additional conditions: a. One (1) parking space for every four (4) residents, including staff residents. b. The proposed facility shall provide appropriate and reasonable security. C. The facility shall have no exterior evidence of such use and no sign advertising such use. d. At the time of original approval, if the proposed facility is to be located within five hundred ( 5 0 0 ) feet of another such facility, public, private or parochial school, group home for adults or juveniles, nursing, rest or convalescent home (center), children's nursery or boarding home, day care center, residential zone, existing residential use, or facility for the mentally or physically handicapped, the City Council may require such additional conditions on the special use permit as it feels are necessary to minimize the effect of the proposed use on the surrounding properties. e. The applicant shall demonstrate that there shall be no negative impact on property within five hundred (500) feet of the proposed facility. ARTICLE 3. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions hereof. ARTICLE 4. It is the intention of the governing body and it is hereby ordained that the provisions of this ordinance shall become and be made a part of the Code of Ordinances of the City of Cape Girardeau, Missouri, and the sections of this Code may be renumbered to accomplish such intention.
