AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE
A QUIT CLAIM DEED TO E & R LEASING COMPANY,
FOR PROPERTY IN THE SOUTHWEST TRUNK SEWER
PROJECT, PHASE 2, SECTION 2
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The Mayor, for and on behalf of the City of Cape
Girardeau, Missouri, is hereby authorized to execute a Quit Claim
Deed to E & R Leasing Company, a Partnership, for property in the
Southwest Trunk Sewer Project, Phase 2, Section 2, and more
particularly described as follows, to -wit:
That part of U.S.P. Survey No. 173, Township 30 North,
Range 13 East, City and County of Cape Girardeau, State
of Missouri, described as follows:
Commence at the Southwest Corner of U.S.P. Survey No.
222, Township 30 North, Range 13 East, the place of
beginning; thence North 70 34' 1211 East, with the West
line of said Survey No. 222, a distance of 141.74 feet;
thence South 480 22' 0701 West, 301.95 feet; thence South
70 34' 1211 West, 267.91 feet; thence North 600 18' 0511
East, 96.41 feet; thence North 480 22' 0711 East, 392.23
-feet; thence North 820 40' 0211 -West, 135.72 feet, to the
place of beginning and containing 68,337.0 square feet,
more or less.
ALSO: That part of U.S.P. Survey No. 173, Township 30
North, Range 13 East, City and County of Cape Girardeau,
State of Missouri, described as follows:
Commence at the Southwest Corner of U.S.P. Survey No.
222, Township 30 North, Range 13 East; thence North 70
34' 1211 East, with the West line of said Survey No. 222,
a distance of 210.54 feet; thence North 830 52' 3411 West,
20.33 feet, to the place of beginning; thence North 830
52' 3411 West, 141.85 feet; thence South 480 22' 0711 West,
53.81 feet; thence South 70 34' 1211 West, 160.71 feet;
thence North 480 22' 0711 East, 270.84 feet, to the place
of beginning and containing 17,045.0 square feet, more or
less.

place of beginning, thence continue South 600 18' 05"

point on the East line of Silver Springs Road; thence

Commence at the Southwest corner of U.S.P. Survey No.
222; thence North 70 34f 12" East, with the West line of
said Survey No. 222, a distance of 210.54 feet; thence
North 830 52' 34" West, 197.36 feet; thence South 70 34f
12" West, 561.0 feet; thence North 830 491 06" West,
265.5 feet to the point of beginning; thence continue
North 830 49' 06" West, 16.0 feet; thence South 140 29'
09" East, 15.56 feet; thence North 750 30' 51" East, 15.0

feet; thence North 140 29' 09" West 10 feet to the point
of beginning and containing 191 square feet.
EXCEPT that the party of the first part reserves the
right, privilege, permission and authority to enter on
and upon said property above described for the purpose of
enabling the City, its agents, servants and assigns to
use said property for construction, final grading, slope
treatment, and seeding, for the extension of Southern
Expressway as shown on plans and specifications therefor
on file in the office of the City Engineer. This
reservation and the rights, privileges, permission and
authority herein reserved shall run with the land but
shall cease and terminate at the time said Southern
Expressway is finally approved and accepted by the City
Council or at such time that the City Council determines
that this reservation is no longer necessary for all or
any.part of the above described property.
ARTICLE 2. This ordinance shall be in full force and effect
ten days after its passage and approval.
