HomeMy WebLinkAboutOrd.2249.10-06-1997BILL NO. 97-222 ORDINANCE NO. a0jl AN ORDINANCE ACCEPTING SEWER EASEMENTS FROM VARIOUS PROPERTY OWNERS, FOR CONSTRUCTION OF A SANITARY SEWER TRUNK EXTENSION TO SERVE TWIN LAKES SUBDIVISION AND THE PROPOSED NOTRE DAME HIGH SCHOOL BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: ARTICLE 1. The City of Cape Girardeau, Missouri, hereby accepts a Sewer Easement, executed by Olive M. Keller, a single person, Paul Hauck and Denise Hauck, husband and wife, and Terry Keller and Nanci Keller, husband and wife, conveying to the City of Cape Girardeau, Missouri, a Sewer Easement for construction of a sanitary trunk extension to serve Twin Lakes Subdivision and the proposed Notre Dame High School, more particularly described as follows, to -wit: A PERMANENT EASEMENT FOR A SANITARY SEWER, 20 FEET WIDE LYING 10 FEET ON EACH SIDE OF THE FOLLOWING DESCRIBED LINE AND ALSO A TEMPORARY CONSTRUCTION EASEMENT, 50 FEET WIDE LYING 25 FEET ON EACH SIDE OF THE FOLLOWING DESCRIBED LINE: Commencing at the Southwest corner of Cape West Third Subdivision recorded in the land records of the _County Recorder's Office in plat book no. 16 at page 82, said point also being on the centerline of Bloomfield Road; Thence along the centerline of Bloomfield Road the following courses and distances: S 55°53123" W, 86.80 feet to the beginning of a curve concave to the southeast having a central angle of 25° 06142" and a radius of 800.00 feet; Thence along said curve in a southwesterly direction, 350.62 feet; Thence 5 30046141" W. 164.64 feet to the beginning of a curve concave to the northwest having a central angle of 06020106" and a radius of 800.00 feet; Thence along said curve in a southwesterly direction, 88.45 feet to the TRUE POINT OF BEGINNING: Thence leaving said centerline, N 84003102" W, 36.61 feet; Thence N 46024123" W, 395.00 feet; Thence N 46023147" W, 1751.92 feet to a point on the West line of a tract of land recorded in the land records of the County Recorder's Office in book no. 552 at page 633, and there terminating. The sidelines of the above described easement being prolonged and shortened to terminate at the centerline of Bloomfield Road and the West line of said tract. ARTICLE 2. The City of Cape Girardeau, Missouri, hereby accepts a Sewer Easement, executed by Georgia L. Bierschwal, Trustee of the Georgia L. Bierschwal Voluntary Trust Agreement dated August 7, 1986 and recorded in Book 450 at Page 758 in the Recorder of Deeds Office of the County of Cape Girardeau, Missouri, and Paul W. Sprenger, Trustee of the Paul W. Sprenger Revocable Trust Agreement dated December 18, 1985 and recorded in Book 459, Page 586 in the Recorder of Deeds Office of the County of Cape Girardeau, Missouri and Dorothy B. Sprenger, Trustee of the Dorothy B. Sprenger Revocable Trust Agreement dated December 18, 1985 and recorded in Book 459 at Page 589 in the Recorder of Deeds Office of the County of Cape Girardeau, Missouri, conveying to the City of Cape Girardeau, Missouri, a Sewer Easement for construction of a sanitary trunk extension to serve Twin Lakes Subdivision and the proposed Notre Dame High School, more particularly described as follows, to -wit: A PERMANENT EASEMENT FOR A SANITARY SEWER, 20 FEET WIDE LYING 10 FEET ON EACH SIDE OF THE FOLLOWING DESCRIBED LINE AND ALSO A TEMPORARY CONSTRUCTION EASEMENT, 50 FEET WIDE LYING 25 FEET ON EACH SIDE OF THE FOLLOWING DESCRIBED LINE: Commencing at the Northeast corner of a tract of land recorded in the land records of the County Recorder's Office in book no. 458 at page 898; Thence N 84°08145" W, 982.86 feet along the North line of said tract to the TRUE POINT OF BEGINNING; Thence S 46°23147" E, 1225.47 feet to a point on the East line_ of said tract, and there terminating. The sidelines of the above described easement being prolonged and shortened to terminate at the North and East lines of said tract. ARTICLE 3. The City of Cape Girardeau, Missouri, hereby accepts a Sewer Easement, executed by Clara Schabbing and Dorothy Schabbing, Trustees of the Clara and Dorothy Schabbing Revocable Trust of 1994, dated July 19, 1994, as amended September 7, 1994, conveying to the City of Cape Girardeau, Missouri, a Sewer Easement for construction of a sanitary trunk extension to serve Twin Lakes Subdivision and the proposed Notre Dame High School, more particularly described as follows, to -wit: A PERMANENT, EASEMENT FOR A SANITARY SEWER, 20 FEET WIDE LYING 10 FEET ON EACH SIDE OF THE FOLLOWING DESCRIBED LINE AND ALSO A TEMPORARY CONSTRUCTION EASEMENT, 50 FEET WIDE LYING 25 FEET ON EACH SIDE OF THE FOLLOWING DESCRIBED LINE: Commencing at the Southeast corner of Tract III recorded in the land records of the County Recorder's Office in book no. 704 at page 4; Thence N 84008145" W, 982.86 feet along the South line of said tract to the TRUE POINT OF BEGINNING; Thence N 46023147" W, 1342.11 feet to a point on the North line of Tract I recorded in the land records of the County Recorder's Office in book no. 704 at page 4, and there terminating. The sidelines of the above described easement being prolonged and shortened to terminate at the North and East lines of said tracts. ARTICLE 4. The City of Cape Girardeau, Missouri, hereby accepts a Sewer Easement, executed by ALBERT C. SCHABBING DAIRY FARMS, INC., a Missouri corporation, conveying to the City of Cape Girardeau, Missouri, a Sewer Easement for construction of a sanitary trunk extension to serve Twin Lakes Subdivision and the proposed Notre Dame High School, more particularly described as follows, to -wit: A PERMANENT EASEMENT FOR A SANITARY SEWER, 20 FEET WIDE LYING 10 FEET ON EACH SIDE OF THE FOLLOWING DESCRIBED LINE AND ALSO A TEMPORARY CONSTRUCTION EASEMENT, 50 FEET WIDE LYING 25 FEET ON EACH SIDE OF THE FOLLOWING DESCRIBED LINE: Commencing at the Southwest corner of a tract of land recorded in the land records of the County Recorder's Office in book no. 409 at page 276; Thence S 84025142" E, 267.77 feet along the South line of said tract to the TRUE POINT OF BEGINNING; Thence N 4602314711W, 338.02 feet to a point on the West line of said tract, and there terminating. The sidelines of the above described easement being prolonged and shortened to terminate at the South and West lines of said tract. ARTICLE 5. The City of Cape Girardeau, Missouri, hereby accepts a Sewer Easement, executed by Albert W. Job, Sr. and Edna I. Job, husband and wife, and Clarence A. Job and Mary K. Job, husband and wife, and Paul M. Job and Betty L. Job, husband and wife, conveying to the City of Cape Girardeau, Missouri, a Sewer Easement for construction of a sanitary trunk extension to serve Twin Lakes Subdivision and the proposed Notre Dame High School, more particularly described as follows, to -wit: EASEMENT NO. 1 Commencing at the Southwest corner of a tract of land recorded in the land records of the County Recorder's Office in book no. 409 at page 276; Thence N 0559124" E, 208.26 feet along the West line of said tract to the TRUE POINT OF BEGINNING; 3. EASEMENT NO. 2 Commencing at the Northwest corner of the West Half of Lot 1 of the Northwest Quarter of Section 3, Township 30 North, Range 13 East of the Fifth Principal Meridian; Thence N 00059136" W, 599.93 feet along the West line of Tract No.3 of a parcel of land recorded in the land records of the County Recorder's Office in book no. 355 at page no. 324, to the TRUE POINT OF BEGINNING; Thence S 27°56115" E, 251.87 feet; Thence S 72°44'37" E, 400.00 feet; Thence S 83 021110" E, 122.58 feet to a point on the centerline of Easement No. 11 and there terminating. The sidelines of the above described easement being prolonged and shortened to terminate at the West line of said tract and the West side line of Easement No. 1. ARTICLE 6. The city of Cape Girardeau, Missouri, hereby accepts a Sewer Easement, executed by Charles E. Schabbing and Patricia J. Schabbing, husband and wife, and William H. Schabbing and Carol a. Schabbing, husband and wife, conveying to the City of Cape Girardeau, Missouri, a Sewer Easement for construction of a sanitary trunk extension to serve Twin Lakes Subdivision and the proposed Notre Dame High School, more particularly described as follows, to -wit: EASEMENT NO. 1 A PERMANENT EASEMENT FOR A SANITARY SEWER, 20 FEET WIDE LYING 10 FEET ON EACH SIDE OF THE FOLLOWING DESCRIBED LINE AND ALSO A TEMPORARY CONSTRUCTION EASEMENT, 50 FEET WIDE LYING 25 FEET ON EACH SIDE OF THE FOLLOWING DESCRIBED LINE: Commencing at the Northwest corner of the West Half of Lot 1 of the Northwest Quarter of Section 3, Township 30 4. The sidelines of the above described easement being prolonged and shortened to terminate at the East line of said tract and the southerly right of way line of Missouri Route "K11. EASEMENT NO. 2 (Along Missouri Route "K11) ALSO A PERMANENT EASEMENT FOR A SANITARY SEWER, 20 FEET WIDE LYING SOUTHERLY OF THE FOLLOWING DESCRIBED LINE AND ALSO A TEMPORARY CONSTRUCTION EASEMENT, 50 FEET WIDE LYING SOUTHERLY OF THE FOLLOWING DESCRIBED: Commencing at the Northwest corner of the West Half of Lot 1 of the Northwest Quarter of Section 3, Township 30 North, Range 13 East of the Fifth Principal Meridian; Thence N 000 59'3611 W, 599.93 feet along the East line of a tract of land recorded in the land records of the County Recorder's office in book no. 347 at page no. 948, Thence N 27056115t1 W, 148.13 feet; Thence N 2900915711 W, 800.00 feet; Thence N 5104514811 W, 916.32 feet to a point on the southerly right of way line of Missouri Route "K11, said point being the TRUE POINT OF BEGINNING; Thence along said Southerly Right of Way line the following courses and distances; S 89°3315411 W, 79.33 feet; Thence N 7805012311 W, 116.69 feet to the West line of a tract of land recorded in the land records of the County Recorder's Office in Book no. 347 at page no. 948 and there terminating. The sidelines of the above described easement being prolonged and shortened to terminate at the West line of the previously described Easement No. 1 and the west line of said tract. EASEMENT NO. 3 A PERMANENT EASEMENT FOR A SANITARY SEWER, 20 FEET WIDE LYING 10 FEET ON EACH SIDE OF THE FOLLOWING DESCRIBED LINE AND ALSO A TEMPORARY CONSTRUCTION EASEMENT, 50 FEET WIDE LYING 25 FEET ON EACH SIDE OF THE FOLLOWING DESCRIBED LINE: 5.
