AN ORDINANCE ESTABLISHING THE BOUNDARIES OF
LATERAL SEWER DISTRICT NO. 8-M, A SUBDIVISION
OF MAJOR DISTRICT NO. 8, APPROVING THE PLANS
AND AUTHORIZING THE CONSTRUCTION OF A SYSTEM
OF SANITARY LATERAL SEWERS IN LATERAL SEWER
DISTRICT NO. 8-M, UNDER A PRIVATE CONTRACT
SUBJECT TO CERTAIN PROVISIONS, IN THE CITY
OF CAPE GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. That the boundaries of Lateral Sewer District No.
8-M, a subdivision of Major District No. 8 in the City of Cape
Girardeau, Missouri, shall be as follows:
Commence at a point being the intersection of the North
right of way line of Bertling Street and the East right
of way line of Sprigg Street Road; thence, Easterly
along said North right of way line of Bertling Street to
a point on the West line of U.S.P.S. 3091; thence,
Northerly along said West line of U.S.P.S. 3091 to a
point being the Northeast corner of a tract of land as
recorded in the land records of the County Recorders
Office in book no. 718 at page no. 431, said point being
on the West line of U.S.P.S. 3091; thence, Easterly
along the West line of U.S.P.S. 3091, 794 feet, more or
less, to a point, said point being the Southeast corner
of a tract of land as recorded in the land records of the
County Recorders Office in book no. 805 at page no. 88;
thence, Northerly along the West line of U.S.P.S. 3091,
1325.75 feet, to a point on the West line of U.S.P.S.
3091, said point also being the Northeast corner of a
tract of land as recorded in the land records of the
County Recorders Office in book no. 805 at page no. 88;
thence, South 89 deg. 13 min. 33 sec. West, 1256 feet, to
a point; thence, North 20 sec. West, 312.66 feet, to a
point on the North line of the aforesaid tract of land;
thence, South 88 deg. 39 min. 43 sec. West, 574.56 feet,
to the Northwest corner of said tract of land as recorded
in the land records of the County Recorders Office in
book no. 805 at page no. 88; thence, South 01 deg. 34
min. 15 sec. West, 919.42 feet, to a point; thence,
North 89 deg. 15 min. 05 sec. East, 348.15 feet, to a
point; thence, North 89 deg. 15 min. 27 sec. East,
102.08 feet, to a point on the West right of way line of
Sprigg Street; , thence, South 01 deg. 28 min. 53 sec.
East, 721.87 feet, to a point being on the North line of
a tract of land as recorded in the land records of the
County Recorders Office in book no. 220 at page no. 439;
thence, Westerly along the North line of the aforesaid
tract of land to the East right of way line of Sprigg
Street Road; thence, Southerly along said East right of
way line of Sprigg Street Road to the point of beginning.
ARTICLE 2. That the plans for the construction of a system of
sanitary lateral sewers to serve Lateral Sewer District No. 8-M, a
copy of which is on file in the office of the City Clerk, have
heretofore been approved and ordered filed.
ARTICLE 3. That the owners of lands in said Lateral Sewer
District No. 8-M are hereby granted permission to construct said
system of sanitary lateral sewers in Lateral Sewer District No. 8-M
and to connect same to existing sewers in Major District No. 8,
subject to the following provisions.
1. That proper authority will be secured to proceed from the
Missouri Clean Water Commission.
2. That all permanent easements for said sewers on private
property are made to the City of Cape Girardeau,
Missouri, prior to execution of a contract for the work
of construction of said sewers.
3. That all City Ordinances, Standard Specifications of the
City and State laws applicable. to this project will be
observed in all respects.
4. That the quality of the work and materials be inspected
by the agents of the City engineer of the said City, and
that cost of said inspections be paid to said City
following the completion of the work.
ARTICLE 4. This ordinance shall be in full force and effect
ten days after its passage and approval.
