AN ORDINANCE AMENDING CHAPTER 30 OF
THE CITY CODE RELATING TO MANUFACTURED
(MOBILE) AND MODULAR UNITS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. That portion of Section 30-2 of the Code of
Ordinances of the City of Cape Girardeau, Missouri, entitled
"Definitions", reading as follows:
Sec. 30-2. Definitions.
Mobile home means a dwelling unit of vehicular,
portable design, built on a chassis, and designed to be
movable from one (1) place to another, and designed to be
used without a permanent foundation (whether or not it is
placed on a foundation).

ARTICLE 2. That portion of Section 30-2 of the Code of
Ordinances of the City of Cape Girardeau, Missouri, entitled
"Definitions", reading as follows:
Sec. 30-2. Definitions.
Mobile home park means a parcel of land which has
been developed for the placement of more than one (1)
mobile home.
is hereby repealed in its entirety, and a new portion of Section
30-2 entitled "Definitions", is hereby enacted in lieu thereof, in
words and figures, to read as follows:

Manufactured home (Mobile home) park means a parcel
of land which has been developed for the placement of
more than one (1) manufactured home (mobile home).
.ARTICLE 3. Section 30-2 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, entitled "Definitions", is hereby
amended by the enactment of new sections, in words and figures, to
read as follows:
Section 30-2. Definitions.
Manufactured home (mobile home) means a factory -
built structure or structures which, in traveling mode,
is eight body feet or more in width or forty body feet or
more in length, or, when erected on site, contains three
hundred twenty or more square feet, equipped with the
necessary service connections and made so as to be
readily movable as a unit or units on its or their own
running gear and designed to be used as a dwelling unit
or units with or without a permanent foundation. The
phrase "without a permanent foundation" indicates that
the support system is constructed with the intent that
the manufactured home placed thereon may be moved from
time to time at the convenience of the owner.
Manufactured homes (mobile homes) are those factory -
built structures manufactured under the authority of the
Federal Manufactured Home Construction and Safety
Standards Act, effective June 15, 1976, and must carry a
seal of approval of the U.S. Department of Housing and
Urban Development (HUD) as required by the Missouri
Public Service Commission.
The term "manufactured home" shall also include
units defined as above if such units are in two or more
separately towable components designed to be joined into
one integral unit capable of being again separated into
the components capable of repeated towing and includes
two or more manufactured home units joined into a single
residential unit which are kept on separate chassis for
repeated towing.
Manufactured business unit (mobile business unit)
means a factory -built structure or structures which, in
the traveling mode, is eight body feet or more in width
or forty body feet or more in length, or, when erected on
site, contains three hundred twenty or more square feet,
equipped with the necessary service connections and made
so as to be readily movable as a unit or units on its or
their own running gear and designed to be used for
commercial, educational, or industrial purposes with or
without a permanent foundation. The phrase "without a
permanent foundation" indicates that the support system
is constructed with the intent that the manufactured unit
placed thereon may be moved from time to time at the
convenience of the owner.
Manufactured business units (mobile business units)
are those factory -built structures manufactured under the
authority of the Federal Manufactured Home Construction
and Safety Standards Act, effective June 15, 1976, and

Modular (home) unit means a transportable building
to be used by itself or to be incorporated with similar
units at a point -of -use into a modular structure to be
used for residential, commercial, educational, or
industrial purposes. This definition shall not apply to
structures under six -hundred -fifty square feet used
temporarily and exclusively for construction site office
purposes.
These units shall be exempt from local building
codes only if the unit bears a seal from the Missouri
Public Service Commission certifying that it meets
construction standards set out by the Building Officials
and Code Administrators International, Inc. (BOCA), the
International Conference of Building Officials (ICBG), or
other national building code recognized by the Missouri
Public Service Commission. If this seal is not present,
the unit must comply with the local building codes.
ARTICLE 4. Section 30-24 (b) (1) of the Code of Ordinances of
the City of Cape Girardeau, Missouri, reading as follows:
Sec. 30-24. "R-111 single-family dwelling district
regulations.

ARTICLE 5. Section 30-24 (b) (8) of the Code of Ordinances of
the City of Cape Girardeau, Missouri, reading as follows:

permit therefor is granted under section 30-

ARTICLE 6. Section 30-35 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, entitled 111MH-1' Mobile Home Park
District Regulations", reading as follows:
Sec. 30-35. " MH -1 " mobile home park district
regulations.
(a) Generally. The regulations set forth in this
section, or set forth elsewhere in this chapter, when
referred to in this section are the district regulations
in the "MH -l" mobile home park district.
(b) Use regulations. Premises shall be used only for
the following purposes:
(1) Mobile home parks for dwelling and park
management purposes only.
(2) Any "R-211 use if a special use permit
therefor is granted under section 30-39.

Regulations", is hereby enacted in lieu thereof, in words and
figures, to read as follows:

Section 30-35. "MH -1" manufactured home (mobile home)
park district regulations.
(a) Generally. The regulations set forth in this
section, or set forth elsewhere in this
chapter, when referred to in this section are
the district regulations in the "MH -1"
manufactured home (mobile home) park district.
(b) Use regulations. Premises shall be used only
for the following purposes:
(1) Manufactured home (mobile home) park for
dwelling and park management purposes only.
(2) Any "R-211 use if a special use permit
therefor is granted under section 30-39.
ARTICLE 7. Section 30-39(d) (30) and (36) of the Code of
Ordinances of the City of Cape Girardeau, Missouri, reading as
follows:
Sec. 30-39. Special use regulations.
(d) Special uses.
(30) Single or double -wide, mobile -home units for
office purposes only in "M-2" heavy industrial
districts.
(36) Single or double -wide, mobile -home units for
temporary office purposes only during
construction or remodeling of a main building
in "M-1" Light Industrial Districts. Any
special use permit, if approved, will become
effective only upon the issuance of a building
permit for a main building. All such temporary
office units shall be removed upon occupancy
of the completed construction or completion or
abandonment of the construction work,
whichever occurs first.

districts.
(36) Single or double -wide, manufactured home or
manufactured business units for temporary
office purposes only during construction or
remodeling of a main building in "M-1" Light
Industrial Districts. Any special use permit,
if approved, will become effective only upon
the issuance of a building permit for a main
building. All such temporary office units
shall be removed upon occupancy of the
completed construction or completion or
abandonment of the construction work,
whichever occurs first.
ARTICLE 8. Section 30-39 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, entitled "Special Use
Regulations" is hereby amended by the enactment of a new section,
in words and figures, to read as follows:
Sec. 30-39. Special use regulations.
(d) Special uses.
(37) Double -wide manufactured homes (mobile homes)
in "R-111, "R-2111 "R-3", or 11R-4" districts,
with the following provisions:
a. The manufactured home shall be in
compliance with Federal Manufactured Home
Construction and Safety Standards,
adopted June 15, 1976, as amended, and
Missouri Public Service Commission rules.
b. The unit when complete shall have a
minimum width of not less than 24
foundation feet as measured at all points
perpendicular to the length of the
manufactured home, which shall not be
less than 42 foundation feet. This
standard is intended to restrict units to
the type which are brought to the site in
parts, typically two halves and at least
1,008 square feet minimum.
C. All wheels, springs, axles, lights, and
towing apparatus shall be removed.

d. The unit must be permanently installed on
a properly designed, enclosed foundation
system in accordance with the BOCA
National Building Code.
e. Orientation of the manufactured housing
unit on the lot shall conform to the same
orientation as the majority of
conventionally built structures in the
immediate area (within 300 feet).
Example: Front door to front lot line,
rear door to rear lot line.
f. Roof must be a gable or hip roof of at
least 3 in 12 pitch or greater and
covered with material that is residential
in appearance, including, but not limited
to approved wood, asphalt composition or
fiberglass shingles, but excluding
corrugated aluminum, corrugated
fiberglass, or metal roofs; except for
permitted deck areas, all roof structures
shall provide an eave projection of no
less than six (6) inches and no greater
than thirty (30) inches.
g. Exterior siding or covering shall be of a
type, quality and appearance customarily
used on conventionally built homes.
h. The lot shall be provided with a hard
surface (not earthen in nature) driveway
not less than 9 -feet wide with side -yard
parking sufficient for the placement of
at least two (2) vehicles.
i. A minimum of eighteen (18) inches of
crawl space under the entire manufactured
home shall be maintained.
j. Permanent steps shall be set at all
external exits with appropriate handrails
and/or guard rails.
k. The unit shall be served by a water
supply and sewage disposal system in
accordance with the International
Plumbing Code, as currently adopted by
the City.

M. Any such structure so installed shall
conform to all applicable zoning and
subdivision ordinances and any other
pertinent ordinance in effect at the time
of installation or construction,
including setback requirements.
ARTICLE 9. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof.
ARTICLE 10. It is the intention of the governing body and
it is hereby ordained that the provisions of this ordinance shall
become and be made a part of the Code of Ordinances of the City of
Cape Girardeau, Missouri, and the sections of this Code may be
renumbered to accomplish such intention.
ARTICLE 11. This ordinance shall be in full force and effect
ten days after its passage and approval.
