AN ORDINANCE ACCEPTING A WATER LINE EASEMENT
FROM CAPE GIRARDEAU LODGE NO. 639 BENEVOLENT
AND PROTECTIVE ORDER OF ELKS OF THE UNITED
STATES OF AMERICA, AND ACCEPTING A SEWER
EASEMENT FROM MIDAMERICA HOTELS CORPORATION
FOR A SANITARY SEWER EXTENSION AND A WATER
MAIN EXTENSION TO SERVE THE ELKS PROPERTY
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby
accepts a Water Line Easement, executed by Cape Girardeau Lodge No.
639 Benevolent Protective Order of Elks of the United States of
America, a not-for-profit corporation, conveying to the City of
Cape Girardeau, Missouri, a Water Line Easement for a water main
extension to serve the Elks property, more particularly described
as follows, to -wit:
An easement 20 feet in width, for public utilities, in
the Southwest fractional quarter of Section 15, and the
Northwest quarter of Section 22, all in Township 31
North, Range 13 East of the Fifth Principal Meridian, the
East line thereof also being the West edge of the private
road, being described as follows:
Commence at the Southeast corner of said Southwest
fractional quarter; thence Northerly along the quarter
section line, 99.00 feet to the Southeast corner of the
"Elks" property (Book 382, Page 522), a distance of
1314.90 feet; thence South 0 degrees 36 minutes 23
seconds East along the 1/16th line, 399.97 feet; thence
North 41 degrees 17 minutes 09 seconds West,83.67 feet
for a place of beginning; thence along the Westerly and
Northerly edge of the gravel road with the following:
North 12 degrees 32 minutes 14 seconds West, 27.92 feet;
North 19 degrees 41 minutes 20 seconds West, 29.45 feet;
North 29 degrees 36 minutes 58 seconds West, 22.54 feet;
North 31 degrees 59 minutes 05 seconds West, 121.05 feet;
North 35 degrees 32 minutes 06 seconds West, 77.28 feet;
North 26 degrees 47 minutes 50 seconds West, 76.46 feet;
North 12 degrees 42 minutes 29 seconds West, 96.58 feet;
North 1 degree 35 minutes 52 seconds West, 58.61 feet;
North 13 degrees 47 minutes 35 seconds East, 73.55 feet;
North 37 degrees 14 minutes 19 seconds East, 63.64 feet;
North 53 degrees 03 minutes 56 seconds East, 76.19 feet;
and North 64 degrees 25 minutes 30 seconds East, 33.13
feet to the terminus of said easement, in Cape Girardeau
County, Missouri.
ARTICLE 2. The City of Cape Girardeau, Missouri, hereby
accepts a Sewer Easement, executed by Midamerica Hotels
Corporation, a Missouri Corporation, conveying to the City of Cape
Girardeau, Missouri, a Sewer Easement for a sanitary sewer
extension to serve the Elks property, more particularly described
as follows, to -wit:
A PART OF THE WEST HALF OF THE NORTHWEST QUARTER, SECTION
22, TOWNSHIP 31 NORTH, RANGE 13 EAST OF THE FIFTH
PRINCIPAL MERIDIAN, CITY AND COUNTY OF CAPE GIRARDEAU,
STATE OF MISSOURI, BEING MORE PARTICULARLY DESCRIBED AS
FOLLOWS:
A STRIP OF LAND 10 FEET WIDE LYING 5 FEET ON EACH SIDE OF
THE FOLLOWING DESCRIBED LINE:
Beginning at a point on the South line of a tract of land
recorded in the land records of the County Recorders
Office in book no. 382 at page no. 522, from which point
a 1/2" Iron Pin (Found) at the most Southerly corner of
said tract bears S 44' 051 44" E, 123.91 feet, said point
also being 5 feet Westerly of and nominal to the West
right of way line of Limbaugh Lane; Thence parallel with
said West right of way line and the following courses and
distances:
S O10 01' 38" E, 1167.76 feet; Thence S 160 25' 21" W.
520.00 feet; Thence departing from said West right of way
line, S 370 06 127" W, 158.00 feet to a point that is
129.24 feet North of and normal to the centerline
Missouri State Route 34 (U. S. Highway 61) station
904+99.73; Thence N 580 441 23" W, 400 feet to a point
that is 126.07 feet North of and normal to the centerline
Missouri State Route 34 station 900+99.74, and
terminating at an existing sanitary sewer manhole.
ARTICLE 3. This ordinance shall be in full force and effect
ten days after its passage and approval.
