AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF 621 SOUTH
KINGSHIGHWAY, CITY AND COUNTY OF CAPE
GIRARDEAU, MISSOURI FROM R-4 TO M-1
WHEREAS, the City Planning and Zoning Commission has
recommended that all of the property described in Article 1 of this
ordinance should be rezoned from R-4, Multiple Dwelling District to
M-1, Light Industrial District; and
WHEREAS, Public Notice of such change was given as prescribed
in -Chapter - 3-0 of th-e—C-ode o -f O-r-din-a-nc-es of th-e—C-ity of C -ape
Girardeau, Missouri, and public hearing was held on Monday, May 5,
1997; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in Article 1
from R-4, Multiple Dwelling District to M-1, Light Industrial
District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, is hereby amended to change the zoning
from the present R-4, Multiple Dwelling District to M-1, Light
Industrial District, for the following described property:
That part of Outlot 86 in USP Survey #2199, Township 30
North, Range 13 East, City and County of Cape Girardeau,
State of Missouri, described as follows:
Start at the Northeast corner of Lot #7 of Ebert's
Subdivision, a part of Outlot 86 and a part of Rodney 400
Arpen Tract; thence South 8 degrees 30 minutes East along
the East line of said Lot 7, 623 feet to a stone on the
North line of Outlot 86 and the South side of the
Bloomfield Road; thence South 80 degrees 30 minutes West
112 feet; thence South 18 degrees 5 minutes east 449.2
feet; thence South 58 degrees 55 minutes East 932.4 feet
to the place of beginning; thence South 16 degrees 2
minutes West 610.3 feet; thence South 81 degrees 42
minutes East 516.9 feet; thence North 8 degrees 00
minutes East 366.8 feet; thence North 49 degrees 46
minutes West 325.5 feet; thence North 58 degrees 55
minutes West 169.8 feet to the place of beginning and
containing 5.5065 acres, subject to all easements of
record. ALSO
A parcel of land containing 1.863 acres, more or less,
located in Outlot 86, USP Survey 2199, Township 30 North,
Range 13 East, City of Cape Girardeau, Missouri,
described as follows: Begin at the point of intersection
of the line between USP Surveys 222 and 2199 with the
West right of way line of US Highway No. 61; said point
bears South 82 degrees 15 minutes east 954.2 feet from
the Northwest corner of USP Survey No. 222; thence North
82 degrees 15 minutes west, 255.0 feet for a corner;
thence North 8 degrees 0 minutes west, 330.5 feet for a
corner; thence South 87 degrees 37 minutes East, 222.0
feet for a corner in the aforesaid West right of way
line; thence South 2 degrees 23 minutes West along said
West line 350.0 feet to the point of beginning.
LESS: That property transferred by general warranty deed
dated October 27, 1992, to Missouri Highway and
Transportation Commission, containing 4.24 acres.
ARTICLE 2. The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present time
particularly suitable for the purposes and uses of M-1, Light
Industrial District, and that such changes authorized hereby are
reasonable and in reasonable conformity with the existing uses
and value of the immediately surrounding properties.
ARTICLE 3. This ordinance shall be in full force and effect
ten days after its passage and approval.
