AN ORDINANCE ESTABLISHING THE BOUNDARIES OF
LATERAL SEWER DISTRICT NO. 14-1-B-5, A
SUBDIVISION OF TRUNK SEWER DISTRICT NO.
14-1-B, APPROVING THE PLANS AND AUTHORIZING
THE CONSTRUCTION OF A SYSTEM OF SANITARY
LATERAL SEWERS IN LATERAL SEWER DISTRICT NO.
14-1-B-5, UNDER A PRIVATE CONTRACT SUBJECT TO
CERTAIN PROVISIONS, IN THE CITY OF CAPE
GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. That the boundaries of Lateral°Sewer District No.
14-1-B-5, a subdivision of Trunk Sewer District No. 14-1-B in the
City of Cape Girardeau, Missouri, shall be as follows:
Commence at the Southeast corner of the Northeast
Quarter of the Northwest Quarter of Section 27; thence
South 85 deg. 33 min. 39 sec. East, 998.93 feet to a
point; thence South 83 deg. 05 min. 34 sec. East to the
centerline of a 50 foot easement for Prospect Dr.;
thence along said centerline South 15 deg. 52 min. 27
sec., 717.36 feet to a point on the property line;
thence departing from said centerline, North 85 deg. 47
min. 07 sec. West, 532.40 feet; thence South 1 deg. 25
min. 15 sec., 665.70 feet; thence North 86 deg. 07 min.
18 sec. , 643.82 feet to a point on the South property
line; thence North 86 deg. 05 min. 31 sec. West, 1309.20
feet; thence South 0 deg. 37 min. 26 sec. West, 180.24
feet to a point on the East right-of-way of Interstate
55; thence Northwesterly along said East right-of-way of
Interstate 55 to the North property line; thence South
87 deg. 02 min. 30 sec. East, 570.80 feet to the place of
beginning containing 59.086 Acres in the City and County
of Cape Girardeau, Missouri, subject to existing
easements, if any.
ARTICLE 2. That the plans for the construction of a system of
sanitary lateral sewers to serve Lateral Sewer District No.
14-1-B-5, a copy of which is on file in the office of the City
Clerk, have heretofore been approved and ordered filed.
ARTICLE 3. That the owners of lands in said Lateral Sewer
District No. 14-1-B-5 are hereby granted permission to construct
said system of sanitary lateral sewers in Lateral Sewer District
No. 14-1-B-5 and to connect same to existing sewers in Trunk Sewer
District No. 14-1-B, subject to the following provisions.
1. That proper authority will be secured to proceed from the
Missouri Clean Water Commission.
2. That all permanent easements for said sewers on private
property are made to the City of Cape Girardeau,
Missouri, prior to execution of a contract for the work
of construction of said sewers.
3. That all City Ordinances, Standard Specifications of the
City and State laws applicable to this project will be
observed in all respects.
4. That the quality of the work and materials be inspected
by the agents of the City engineer of the said City, and
that cost of said inspections be paid to said City
following the completion of the work.
ARTICLE 4. This ordinance shall be in full force and effect
ten days after its passage and approval.
