AN ORDINANCE AUTHORIZING THE CITY MANAGER TO
EXECUTE AMENDMENT NO. 1 TO AN AGREEMENT FOR
ENGINEERING SERVICES WITH BLACK & VEATCH, FOR
THE TRANSPORTATION IMPROVEMENTS PROGRAM
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City Manager, for and on behalf of the City of
Cape Girardeau, Missouri, is hereby authorized to execute Amendment
No. 1 to an Agreement for Engineering Services dated February 15,
1996, with Black & Veatch, for the transportation improvements
program. A copy of said Amendment No. 1 is attached to this
Ordinance and made a part hereof.
ARTICLE This ordinance shall be in full force and effect
ten days after its passage and approval.

AMENDMENT NO. 1
TO
AGREEMENT FOR ENGINEERING SERVICES
FOR
CITY OF CAPE GIRARDEAU, MISSOURI
TRANSPORTATION IMPROVEMENTS PROGRAM
WHEREAS, an Agreement for Engineering Services dated February 15,
1996, with Purchase Order No. 13896/ Notice to Proceed dated
April 8, 1996 (the "Agreement") , now exists and is full force
between the City of Cape Girardeau ("Owner") and Black & Veatch
("Engineer") ; and,
WHEREAS, the scope of services for the project as described in
Attachment A of the Agreement is being expanded to include
additional field survey work, design engineering services,
preparation of drawings and specifications, and consulting
services as described in Attachment 1A, Scope of Services; and,
WHEREAS, Engineer is prepared to provide the Services; and,
WHEREAS, Owner agrees to pay Engineer for the additional services
in accordance with Attachment 1B, Compensation; and,
WHEREAS, Owner shall be responsible for all matters described in
Attachment 1C, Owner's Responsibilities;
NOW THEREFORE, in consideration of the promises contained in the
Agreement and Amendment No. 1, Owner and Engineer agree to amend
the Agreement as stipulated in this Amendment No. 1;
IN WITNESS WHEREOF, Owner and Engineer have executed this
Amendment No. 1 to the Agreement.

TO
AMENDMENT NO. 1
FOR
CITY OF CAPE GIRARDEAU, MISSOURI
TRANSPORTATION IMPROVEMENTS PROGRAM
SCOPE OF SERVICES
Owner: City of Cape Girardeau, Missouri
Project: Transportation Improvements Program
The authorized scope of services for this project includes
surveying, preliminary studies, design engineering, public
involvement, right-of-way and easement acquisition, and preparation
of construction drawings, specifications, and bidding documents.
Engineer shall provide the following additional services:
PHASE 1. INITIAL INVESTIGATIONS AND PRELIMINARY STUDY
A. Preliminary and General Items
1. Meet with Owner and review the routes of a new 12 -inch
and 8 -inch diameter water main along Perryville Road,
approximately 5,000 feet long.
2.. Review and incorporate the locations of. sanitary
encasement pipe for future use by Owner.
B. Collect Existing Information
1. Incorporate Owner's water distribution system standards.
2. Incorporate Owner's sewerage system standards.
C. Traffic Capacity Determinations - no change
D. Alignment and Profile study - no change
E. Hydrology and Hydraulics Study
1. Prepare stormwater routing calculations and hydraulic
design for four detention basins, two on Perryville Road,
one on Bloomfield Road, and one on Broadway.

2. Prepare preliminary and final design for a new storm
drainage outfall from the Broadway project south and.west
along Helena and Clark Streets, to the existing system
along Bessie Street draining to the Walker Branch flood
control channel, a distance of 1000 to 1500 feet,
depending on the final alignment.
F. Pavement Design - no change
G. Traffic Signal Upgrade
1. Based upon the results of the existing system review
(original scope), provide field traffic counts for
turning movements and peak lane volumes at the twelve
intersections to be upgraded.
2. Prepare complete traffic signal design and phasing plan
for a new signal at the intersection of Broadway and
Clark Ave.
H. Public Involvement Program
1. Provide additional services to incorporate the "Roads to
Success" logo and color change in the newsletter.
2. Provide additional staffing to handle an anticipated
larger attendance at the Broadway Public Meeting.
PHASE 2A. FIELD SURVEYS AND PROPERTY SURVEYS
A. Preliminary and General Items
1. Coordinate route and outfall location for Broadway
stormwater outfall with Owner.
2. Obtain as -built records as needed from Owner and the Army
Corps of Engineers.
3. Coordinate general location for the Bloomfield Road
detention basin with Owner.
B. Route Surveys and Property Surveys
1. Provide horizontal and vertical controls, topographic
survey and mapping, and general property ownership and
right-of-way information for the Broadway stormwater

outfall. Location of the outfall within existing street
right-of-way or City -owned easement is anticipated so
that detailed plats and legal descriptions are not
required.
2. Provide a topographic construction survey of the
Bloomfield Road detention basin site, which extends
approximately 500 feet upstream, beyond the limits of the
roadway survey.
PHASE 2B. DESIGN, CONSTRUCTION DRAWINGS, SPECIFICATIONS, AND BID
DOCUMENTS
A. Preliminary and General Items - no change
B. Design Memorandum - no change
C. Geotechnical Services - no change
D. Construction Drawings and Specifications
1. Prepare additional construction drawings, details, and
specifications for construction of a new water main along
Perryville Road.
2. Prepare additional construction drawings, details, and
specifications for construction of the stormwater
detention basins.
3. Prepare additional construction drawings, details, and
specifications for construction of a new signalized
intersection at Broadway and Clark Ave.
4. Prepare additional construction drawings, details, and
specifications for construction of a stormwater outfall
from the Broadway project south and west along Helena and
Clark Streets, to the existing system along Bessie Street
leading to the. Walker Branch flood control channel.

TRANSPORTATION IMPROVEMENTS PROGRAM
COMPENSATION
Owner: City of Cape Girardeau, Missouri
Project: Transportation Improvements Program
For the services covered by this Amendment No.l, the Owner agrees
to pay the Engineer as follows:
A. For Phase 1 Services (Initial Investigations), 2A Services
(Field and Property Surveys), and 2B Services (Design,
Construction Drawings and Bid Documents), an amount equal to the
Engineer's salary costs times 2.95 plus reimbursable expenses at
cost and plus subcontract billings times 1.05.
B. Salary costs and expenses will be included with the original
contract amounts and the billing limits increased as follows:
_Street Improvements Design Services
Original Contract $355,000
Amendment No. 1 46,800
Total $401,800
Traffic Signal Upgrade Design Services
Original Contract $60,000
Amendment No. 1 15,000
Total $75,000
C. All agreements regarding compensation specified in
Attachment B of the Agreement remain in place. The services
provided by this Amendment will not need to be separated out from
the original contract for periodic payments or other purposes.

OWNER'S. RESPONSIBILITIES
Owner: City of Cape Girardeau, Missouri
Project: Transportation Improvements Program
The Owner will furnish, as required by the work and not at the
expense of the Engineer, the following items:
A. All maps, drawings, reports, records, and other data that
are available in the files of the Owner and which may be useful
in the work involved under this Amendment.
B. Access to public and private property when required in
performance of the Engineer's services.
C. The services of at least one of the Owner's employees or
staff who has the right of access to, and who has knowledge of,
the existing streets and traffic signal equipment.
D. Obtaining any needed permits or authorizations from the Army
Corps of Engineers to construct the stormwater outfall or
stormwater detention areas.
E. All other items specified in Attachment C of the Agreement
remain in effect.
