AN ORDINANCE VACATING THE CITY'S INTEREST IN A
UTILITY EASEMENT IN OAK HILLS SUBDIVISION, IN
THE CITY OF CAPE GIRARDEAU, MISSOURI
WHEREAS, the City Council has received a request from Mr. &
Mrs. Guy Schwab that the City vacate a utility easement for a sewer
line which runs under their house at 1827 Huntington Drive in Oak
Hills Subdivision, and more particularly described in Section 1
hereof; and
WHEREAS, the City Council set the date of April 7, 1997, for
a public hearing on this request; and
WHEREAS, at least ten (10) days notice of the time and place
of this hearing was published in a newspaper of general circulation
in the City; and
WHEREAS, a public hearing was held on April 7, 1997, at which
all interested parties were afforded the opportunity to speak in
favor of or in opposition to the proposed utility easement
vacation; and
WHEREAS, the City Council has determined that the utility
easement in question is not necessary or needed for the purposes
for which it was dedicated and established; and
WHEREAS, it is in the public interest that the utility
easement be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The City's interest in a utility easement on the
following described real estate:
A strip of land 10 feet wide, lying 5 feet on either side
of the line between Lots G and 7, Block 1, Oak Hills
Subdivision, in the City of Cape Girardeau, Missouri.
is hereby vacated.
ARTICLE 2. This ordinance shall be in full force and effect
ten days after its passage and approval.

acknowledged said instrument to be the free act and deed of said
City.
