BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby accepts a Permanent
Easement executed by Pamela Gale Johnson, Chapter 7 Trustee for the Estate of
Panhandle Southern, Inc., conveying to the City of Cape Girardeau, Missouri, a
Permanent Easement for the Phase I Facility Plan for Sanitary Sewer Improvement
Program, more particularly described as follows, to -wit:
Part of Lots 2, 3 and 6 in Block 5 of West End Place Second Addition in
the City and County of Cape Girardeau, Missouri, more particularly
described as follows:
Begin at the Northwest corner of Lot 2 in Block 6 of said subdivision,
thence South 820 24' 19" East, with the North line of said Lot 2, a
distance of 5.00 feet; thence South 05' 30' 50" West, a distance of
237.16 feet to a point in the South line of Lot 5 in said Block 6; thence
South 76' 36' 68" West along the South line of Lot 5, a distance of
5.28 feet to the Southwest corner of Lot 5; thence North 05' 30' 50"
East with the West line of Lots 5, 3 and 2, a distance of 239.05 -feet to
the place of beginning, and containing 1191 square feet, more or less.
ARTICLE 2. The City of Cape Girardeau, Missouri, hereby accepts a Temporary
Construction Easement executed by Pamela Gale Johnson, Chapter 7 Trustee for the
Estate of Panhandle Southern, Inc., conveying to the City of Cape Girardeau, Missouri,
a Temporary Construction Easement for the Phase I Facility Plan for Sanitary Sewer
Improvement Program, more particularly described as follows, to -wit:
Part of Lots 2, 3 and 5 in Block 5 of West End Place Second Addition in
the City and County of Cape Girardeau, Missouri, more particularly
described as follows:
Commence at the Northwest corner of Lot 2 in Block 6 of said
subdivision, thence South 82'24'19" East, with -the North line of said
Lot 2, a distance of 5.00 feet, to the place of beginning; thence continue
South 82'24'19 " East, with the North line of said Lot 2, a distance of
16.01 feet; thence South 05'30'50" West, a distance of 231.47 feet
to a point in the South line of Lot 6 in Block 5 in said subdivision; thence
South 76°85'68" West with the South line of said Lot 5, a distance of
16.86 feet to a point; thence North 06030'50" East, a distance of
237.16 feet to the place of beginning, and containing 3,515 square feet,
more or less.
ARTICLE 3. This ordinance shall be in full force and effect ten days after its
passage and approval.
