ORDINANCE NO.
AN ORDINANCE ACCEPTING PERMANENT EASEMENTS
AND TEMPORARY.' CONSTRUCTION EASEMENTS FROM
JAMES A. PHEGLEY; KENNETH O. WINDISCH AND JANE
E. WINDISCH FOR THE TWIN LADES SUBDIVISION
SANITARY SEWER PROJECT.
BE IT' ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby accepts a Permanent
Easement executed by James A. Phegley, a single person, conveying to the City of Cape
Girardeau, Missouri, a Permanent Easement for the 'T'win Lakes Subdivision Sanitary Sewer
Project, more particularly described as follows, to -wit:
Part of the Northwest Quarter of Section 34• and part of the Southwest Quarter of Section 27, in
Township 31 North, Range 13 East, in the County and City of Cape Girardeau, Missouri, more
particularly described as follows: Commencing at the Northeast corner of a tract of land owned by
James A. Phegley as recorded in Book 834 on Page 921 in the Cape Girardeau County Office of the
Recorder in Jackson, Missouri; thence along the East line of said tract, South 00 degrees, 40 minutes,
52 seconds East, 469.24 feet to a point, said point having M.S.P.C. of N: 543874.'7738(ft) E:
1084079.34(ft), said point also being the point of beginning; thence continuing along the said East line,
South 00 degrees, 40 minutes, 52 seconds East, 23.91 feet to a point; thence leaving said East line,
South 39 degrees, 06 minutes, 27 seconds West, parallel to the proposed sewer line, 213.87 feet to
a point; thence North 86 degrees, 35 minutes, 28 seconds West, parallel to the proposed sewer line,
17.29 feet to a point in the West line of said tract; thence along said West line, North 00 degrees, 14
minutes, 53 seconds West, 15.03 feet to a point; thence leaving said West line, South 86 degrees, 35
minutes, 28 seconds East, parallel to the proposed sewer line, 10.56 feet to a point; thence North 39
degrees, 06 minutes, 27 seconds East, parallel to the proposed sewer line, 224.80 feet to the point of
beginning and containing 3,499 square feet, more or less.
ARTICLE 2. The City of Cape Girardeau, Missouri, hereby accepts a Temporary
Construction Easement executed by James A. Phegley, a single person, conveying to the City
of Cape Girardeau, Missouri, a Temporary Construction Easement for the Twin Lakes
Subdivision Sanitary Sewer Project, more particularly described as follows, to -wit:
Part of the Northwest Quarter of Section 34 and part of the Southwest Quarter of Section 27, in
Township 31 North, Range 13 East, in the County and City of Cape Girardeau, Missouri, more
particularly described as follows: Commencing at the Northeast corner of a tract of land owned by

conveying to the City of Cape Girardeau, Missouri, a Permanent Easement for the Twin lakes
Subdivision Sanitary Sewer Project, more particularly described as follows, to -wit:
Part of Lot 22 of Twin Lakes Subdivision in Cape Girardeau County and City in the State of Missouri,
more particularly described as follows: Commencing at the Northeast corner of a tract of land owned
by Kenneth O. and Jane E. Windisch as recorded in Book 476 on Page 653 in the Cape Girardeau
County Office of the Recorder in Jackson, Missouri; thence along the North line of said tract, North
89 degrees, 52 minutes, 43 seconds West, 56.16 feet to the point of beginning, said point having
M.S.P.C. of N:542526.49 (ft) E:1084.017.15 (ft); thence leaving said North line, South 28 degrees,
04 minutes, 07 seconds West, parallel to the proposed sewer line, 119.39 feet to a point; thence North
78 degrees, 50 minutes, 14 seconds West, parallel to the proposed sewer line, 120.32 feet to a point;

wife, conveying to the City of. Cape Girardeau, Missouri, a Temporary Construction Easement
for the Twin Lakes ,Subdivision Sanitary Sewer Project, more particularly described as follows,
to -wit:

more particularly described as follows: Commencing at the Northeast corner of a tract of land owned
